<br /> At a Regular Meeting of the City Council on Tuesday, October 28, 2003,
<br />there were present:
<br />
<br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts,
<br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W.
<br />Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman.

<br /> Councilman Charles B. Whitehurst, Sr. opened the meeting with prayer, which
<br />was followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a
<br />Called Meeting on October 14, 2003, and a Regular Meeting on October 14, 2003, and
<br />was adopted by unanimous vote.

<br />03 - 372 - Use permit:

<br />(b) UP-03-17
<br />
<br /> HODGES FERRY NEIGHBORHOOD - J. Wayne Sprinkle,
<br /> representing Alma F. Flenner, requests a use permit to operate a
<br /> banquet facility for Clayton's Restaurant at 1811 Hodges Ferry
<br /> Road. Deferred from the October 14, 2003 City Council meeting.

<br />Mark A. Geduldig-Yatrofsky, 363 Middle Street, spoke in opposition to this item.
<br />Charles J. Bodnar, 114 Snead Fairway, spoke in opposition to this item.
<br />Anna Hayden, 810 Nottingham Road, spoke in opposition to this item.
<br />Jim Ellis, 805 Arnold Palmer Drive, spoke in opposition to this item.
<br />Thomas Engram, 807 Arnold Palmer Drive, spoke in opposition to this item.
<br />Martha Ann Creecy, 317 Dinwiddie Street, spoke in opposition to this item.

<br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to defer consideration of

<br />UP-03-17 to the meeting of November 25, 2003, and was defeated by a vote of 4-3
<br />(Moody, Randall, Whitehurst).

<br /> Motion by Mr. Benn, and seconded by Mr. Pitts, that UP-03-17 be approved on
<br />first reading, and was adopted by a vote of 5-2 (Randall, Whitehurst).

<br />03-372 - Rezoning and use permit:
<br />
<br />1. Alfred R. Lee, 3612 Forest Haven Lane, spoke in opposition to this item.
<br />
<br />2. Debra Briggs, 3620 Forest Lane, spoke in opposition to this item.
<br />
<br /> Motion by Mr. Benn, and seconded by Mr. Moody, to adopt the following
<br />ordinance, approved on first reading at the October 14, 2003 meeting, and was adopted
<br />by the following vote:
