October 28, 2003 At a Called Meeting of the City Council on Tuesday, October 28, 2003, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, *J. Thomas Berm III, William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. 03 - 388 - The following call for the meeting was read: "Please attend a Called Manager's Conference Room, Meeting of the City Council to be held in the City 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, October 28, 2003 for the purpose of a Public Work Session. In addition, you may consider a motion to go into a Closed Meeting. By order of the Mayor." 03 - 389 - The following items were discussed in Public Work Session: 1. Friends of the Juvenile Court - Debbie Steiger 2. Concessionaire for Bide-A-Wee -"Friends on the Green" - Mr. Campbell/Ms. Mitchell 3. Olde Towne Flea Market Report - Scott Demharter 4. Clayton's Restaurant 03 - 390 - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to discuss or consider the following: the acquisition of real property for a public purpose, as per subsection 3; and legal matters requiring the advice of legal counsel, as per subsection 7. The subject matter of the meeting includes the possible negotiation and acquisition of certain real estate for a public purpose, and legal matters involving legal documents and interpretation of the laws of the Commonwealth of Virginia. The purpose of the meeting is to permit frank and confidential discussion of matters for which premature disclosure could harm the interests of the City and its citizens. The motion was adopted by unanimous vote. Motion by Mr. Moody, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the immediately preceding Closed Meeting of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and 2. Only such public business matters as were identified in the motion by which the Closed Meeting was convened, were heard, discussed or considered in the meeting by the City Council. The motion was adopted by unanimous vote.
