September 9, 2003 <br /> <br /> At a Called Meeting of the City Council on Tuesday, September 9, 2003, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />J. Thomas Benn III, *William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. <br />Randall, City Manager C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />03 - 313 - The following call for the meeting was read: <br /> <br /> "Please attend a Called <br />Manager's Conference Room, <br /> <br />Meeting of the City Council to be held in the City <br />801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, <br /> <br />September 9, 2003 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br />By order of the Mayor." <br />03 - 314 - The following items were discussed in Public Work Session: <br /> <br />1. 2026 Hampton Roads Regional Transportation Plan - Dwight Farmer/Art Collins <br /> <br />2. City Council Retreat Update - Kenneth Wheeler/Dr. Patton/Lee Dumbauld/ <br /> Steve Lynch <br /> <br />3. Items Submitted by City Manager - Enterprise Zone- Steve Lynch <br /> - International Downtown Association Conference, Cleveland, OH - Mr. McCoy <br /> <br />03 - 315 - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br /> appointments to boards and commissions, as per subsection 1; and <br /> <br /> legal matters requiring the advice of legal counsel, including the threat of <br />litigation as per subsection 7. <br /> <br /> The subject matter of the meeting includes appointment of citizens to boards and <br />commissions, and legal matters involving interpretation of the laws of the <br />Commonwealth of Virginia, including the threat of litigation. <br /> <br /> The purpose of the meeting is to protect the public interest by ensuring frank and <br />confidential discussion of matters for which disclosure could harm or jeopardize the <br />public interest. <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Pitts, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br /> 1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br /> 2. Only such public business matters as were identified in the motion by which <br /> the Closed Meeting was convened, were heard, discussed or considered in <br /> the meeting by the City Council. <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> <br />
