Au,qust 26, 2003 <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Patrick Olds is hereby granted a use permit pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (1988) for the operation of an eating <br />establishment at 1201 London Boulevard, and being more particularly described as: <br /> <br />UP-03-19 <br /> <br />Beginning at the southwest corner of London Boulevard and <br />Elm Avenue; thence, in a westerly direction 155'_+ to a point; <br />thence in a southerly direction 117'_+ to a point; thence, in an <br />easterly direction 155'_+ to point; thence, in a northerly <br />direction 117'_+ to a point of the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which shall <br />be observed by the applicant and any successor in interest: <br /> <br /> (a) The facility's use shall be limited to a delivery and carryout eating <br />establishment. <br /> <br /> (b) <br />plan. <br /> <br />The operation shall adhere to the approved site/parking plan and floor <br /> <br /> (c) All exterior alterations, including signage, must be approved by the <br />Downtown Design Committee prior to installation. <br /> <br /> (d) The parking lot shall adhere to all city code requirements, including those <br />of City Code Section 40-71.1, and must be reviewed and approved during the site plan <br />review process. <br /> <br />(e) A 10% tree canopy requirement must be maintained. <br /> <br /> (f) Days and hours of operation shall be Sunday through Thursday, <br />11:00 a.m. to 11:00 p.m., and Friday through Saturday, 11:00 a.m. to 1:00 a.m. <br /> <br /> (g) The facility shall be operated in accordance with all applicable codes <br />ordinances, and regulations of federal, state, and local governments, and all required <br />permits and licenses shall be obtained and maintained in effect. <br /> <br /> (h) Trash shall be stored, handled, and removed in accordance with a plan <br />approved by the Director of General Services on May 20, 2003. <br /> <br /> (i) <br />manner. <br /> <br />All taxes in connection with the subject property shall be paid in a timely <br /> <br /> 4.
