July 22, 2003 <br /> <br /> At a Called Meeting of the City Council on Tuesday, July 22, 2003, there were <br />present: <br /> <br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, <br />*William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, City Manager <br />C. W. McCoy, City Attorney G. Timothy Oksman. <br /> <br />03 - 251 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the <br />Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., <br />July 22, 2003 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />03 - 252 - The following items were discussed in Public Work Session: <br /> <br />1. Path of History - Portsmouth, Virginia <br /> <br />2. 3401 Portsmouth Boulevard <br /> <br />3. City Code Amendment - Chapter 40 <br /> <br />03 - 253 - Motion by Ms. Randall, and seconded by Mr. <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the <br />discuss or consider the following: <br /> <br />3; and <br /> <br /> City <br />Tuesday, <br /> <br />Moody, to go into Closed <br /> Code of Virginia, to <br /> <br />- appointments to boards and commissions, as per subsection 1; <br /> <br />- the acquisition or sale of real property for a public purpose, as per subsection <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> The subject matter of the meeting includes appointments of citizens to boards <br />and commissions, the possible acquisition and possible sale and development of certain <br />real estate properties for public purposes, and legal matters involving legal documents <br />and interpretation of the laws of the Commonwealth of Virginia. The purpose of the <br />meeting is to protect the public interest by ensuring frank and confidential discussion of <br />matters for which disclosure could harm or jeopardize the public interest. <br /> <br />- legal matters requiring the advice of legal counsel, as per subsection 7. <br /> <br /> <br />
