July 8, 2003 <br /> <br /> At a Called Meeting of the City Council on Tuesday, July 8, 2003, there were <br />present: <br /> <br />Vice Mayor Bernard D. Griffin, Sr., *J. Thomas Berm III, William E. Moody, Jr., Charles <br />B. Whitehurst, Sr., Marlene W. Randall, City Manager C. W. McCoy, City Attorney G. <br />Timothy Oksman. <br /> <br />03 - 237 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City <br />Manager's Conference Room, 80'1 Crawford Street, 6th floor, 5:00 p.m., Tuesday, <br />July 8, 2003 for the purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br />By order of the Mayor." <br />03 - 238 - The following items were discussed in Public Work Session: <br />'1. Westbury Update - Kathy Warner <br /> <br />2. Mosquito Control Program - James R. Spacek <br />3. New Market Tax Credits - David Tynch <br />4. Agreement for Coleman's <br /> <br />03 - 239 - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-371'1(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br /> - appointments to boards and commissions, as per subsection 1; <br /> <br /> - the acquisition or sale of real property for a public purpose, as per subsection <br /> <br />3; and <br /> <br />- legal matters requiring the advice of legal counsel, as per subsection 7. <br /> <br />The subject matter of the meeting includes appointments of citizens to boards and <br />commissions, the possible acquisition and possible sale and development of certain real <br />estate properties for public purposes, and legal matters involving interpretation of the <br />laws of the Commonwealth of Virginia. The purpose of the meeting is to protect the <br />public interest by ensuring frank and confidential discussion of matters for which <br />disclosure could harm or jeopardize the public interest. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> <br />
