Mark Geduldig-Yatrofsky, 363 Middle Street, spoke in opposition to this item. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following <br />resolution, approved on first reading at the February 11, 2003 meeting, and was <br />adopted by the following vote: <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-03-02) TO THE WHITMORE COMPANY TO CONSTRUCT 250 APARTMENT <br />UNITS AT 850 CRAWFORD PARKWAY. <br /> <br /> WHEREAS, The Whitmore Company has made application pursuant to Section <br />40-112 of the Code of the City of Portsmouth, Virginia (1988), as amended, for the <br />approval and granting of a group housing use permit for 250 apartments to be <br />constructed at 850 Crawford Parkway, Portsmouth, Virginia, more particularly described <br />as follows: <br /> <br />GHP-03-02 <br /> <br />Beginning at the northwest intersection of Effingham Street <br />and Crawford Street thence west approximately 659 feet <br />along the northern right-of-way line of Crawford Street to <br />Fort Lane; thence north approximately 251 feet along the <br />eastern right-of-way line of Fort Lane to Leckie Street; <br />thence west approximately 480 feet along the northern right- <br />of-way line of Leckie Street to Hatton Street; thence north <br />approximately 244 feet along the eastern right-of-way line of <br />Hatton Street to Naval Avenue; thence east approximately <br />143 feet along the southern right-of-way line of Naval <br />Avenue to Parkview Avenue; thence north approximately 30 <br />feet along the eastern right-of-way line of Parkview Avenue <br />to a point; thence east approximately 1101 feet to Effingham <br />Street; thence south approximately 400 feet along the <br />western right-of-way lines Effingham Street to the point of <br />beginning. <br /> <br />and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended conditional approval of said <br />application; and <br /> <br /> WHEREAS, the applicant has been informed that approval of the group housing <br />project pursuant to Section 40-116 only grants an exemption from certain requirements <br />for residences as stated in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the <br />City of Portsmouth, Virginia, or any other applicable local, state or federal law or <br />regulation; and <br /> <br /> WHEREAS, the applicant is aware that building permits and any other required <br />permit will be issued only upon compliance with the ordinances, laws or regulations <br />applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1.
