Februar~ 25, 2003 <br /> <br />(f) All drop off and pick up of children shall be limited to Arden Street. <br /> <br /> (g) The outdoor play area shall be enclosed with fencing that is at least four <br />feet in height. <br /> <br />(h) The center shall comply with the submitted floor plan and site plan. <br /> <br /> (i) Trash and garbage shall be stored, handled and removed in accordance <br />with a plan approved by the Department of General Services. <br /> <br /> (j) The facility shall submit to all required inspections by the City's Fire <br />Prevention Bureau, Public Health Department and Building Official and shall promptly <br />correct any deficiencies noted. <br /> <br /> (k) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and maintain all <br />necessary licenses and permits. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />03-44(e): <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-03-01) TO PORTSMOUTH GARDENS APARTMENTS, LLC, TO RENOVATE <br />AND CONSTRUCT 180 APARTMENT UNITS AT 3400 GLASGOW STREET. <br /> <br /> WHEREAS, Portsmouth Gardens Apartments, LLC, has made application <br />pursuant to Section 40-112 of the Code of the City of Portsmouth, Virginia (1988), as <br />amended, for the approval and granting of a group housing use permit for the <br />renovation and construction of 180 apartment units at 3400 Glasgow Street, <br />Portsmouth, Virginia, more particularly described as follows: <br /> <br />GHP-03-01 <br /> <br />Beginning at the northwest corner of the intersection of <br />Glasgow Street and Cambridge Avenue; thence in a <br />northerly direction approximately 800' to a point; thence in a <br />southwesterly direction approximately 2620' to a point; <br />thence in a easterly direction approximately 1175' to the <br />point of beginning. <br /> <br />and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended conditional approval of said <br />application; and <br /> <br /> WHEREAS, the applicant has been informed that approval of the group housing <br />project pursuant to Section 40-116 only grants an exemption from certain requirements <br />for residences as stated in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the <br />City of Portsmouth, Virginia, or any other applicable local, state or federal law or <br />regulation; and <br /> <br /> WHEREAS, the applicant is aware that building permits and any other required <br />permit will be issued only upon compliance with the ordinances, laws or regulations <br />applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That, coupled with the terms imposed by paragraph 2 hereof, the following <br />conditions exist: <br /> <br />(a) The proposed project is compatible with surrounding land uses; <br /> <br /> <br />
