May 24, 1994 <br /> <br />UP-94-4 <br /> <br /> Beginning on the east right-of-way line of Elm Avenue a <br />distance of 150 feet south from its intersection with Lincoln <br />Street; thence east along a' side property line 100 feet to a <br />point; thence south $7.5 feet to a point; thence west 100 feet <br />to the east rigHt-Of=way:line of Elm Avenue; thence north along <br />said right-of-way 37.5 feet to the point of beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />a. The facility must receive state licensing prior to <br />occupancy and have annual fire and building code inspections. <br /> <br />b. The-existing six (6~'~oot wood privacy fence must be <br />maintained. <br /> <br />c. The facility shall be limited to no more than five (5) <br />residents, fifty-flve (55) years of age or older or disabled. <br /> <br />d. The use permit is not transferable. <br /> <br />e. Hedges along the southwestern property lines must be cut <br />back to provide a sight line for ingress and egress. <br /> <br />f. Three (3) parking spaces must be provided in accordance <br />with Exhibit A, attached hereto and made a part hereof. <br />Parking for the facility is restricted to the rear of the <br />property. <br /> <br />g. The applicant shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />governments and shall obtain and maintain all necessary <br />licenses and permits. <br /> <br />h. Any repeated violations of the City's building, fire or <br />environmental codes shall constitute grounds for revocation of <br />the use permit." <br /> <br />Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br />(c) Motion by Mr. Griffin, and seconded by Mr. Hawks, the <br />following resolution, approved on first reading at the Public <br />Hearing on May 9, 1994, was adopted and by the following vote: <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH <br />COMMUNITY SERVICES BOARDFOR THE OPERATION OF AN ADULT DAY-CARE <br />CENTER LOCATED AT 1927 HIGH STREET. <br /> <br /> WHEREAS, the Portsmouth Community Services Board has made <br />application pursuant to Section 40-43.1 of the Code of the City <br />of Portsmouth, Virginia (1988), for the granting of a use <br />permit, to operate an adult day-care center at 1927 High <br />Street, Portsmouth, Virginia, as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> <br />
