May 24, 1994 UP-94-4 Beginning on the east right-of-way line of Elm Avenue a distance of 150 feet south from its intersection with Lincoln Street; thence east along a' side property line 100 feet to a point; thence south $7.5 feet to a point; thence west 100 feet to the east rigHt-Of=way:line of Elm Avenue; thence north along said right-of-way 37.5 feet to the point of beginning. 3. That this use permit is approved subject to the following conditions: a. The facility must receive state licensing prior to occupancy and have annual fire and building code inspections. b. The-existing six (6~'~oot wood privacy fence must be maintained. c. The facility shall be limited to no more than five (5) residents, fifty-flve (55) years of age or older or disabled. d. The use permit is not transferable. e. Hedges along the southwestern property lines must be cut back to provide a sight line for ingress and egress. f. Three (3) parking spaces must be provided in accordance with Exhibit A, attached hereto and made a part hereof. Parking for the facility is restricted to the rear of the property. g. The applicant shall comply with all applicable codes, ordinances and regulations of federal, state and local governments and shall obtain and maintain all necessary licenses and permits. h. Any repeated violations of the City's building, fire or environmental codes shall constitute grounds for revocation of the use permit." Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb Nays: None (c) Motion by Mr. Griffin, and seconded by Mr. Hawks, the following resolution, approved on first reading at the Public Hearing on May 9, 1994, was adopted and by the following vote: "A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH COMMUNITY SERVICES BOARDFOR THE OPERATION OF AN ADULT DAY-CARE CENTER LOCATED AT 1927 HIGH STREET. WHEREAS, the Portsmouth Community Services Board has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988), for the granting of a use permit, to operate an adult day-care center at 1927 High Street, Portsmouth, Virginia, as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
