October 8, 2002 <br /> <br /> Non-Arbitraqe Certificate and Tax Covenants. The Chief Financial Officer of the <br />City and such officers and agents of the City as she may designate are authorized and <br />directed to execute a Non-Arbitrage Certificate and Tax Covenants setting forth the <br />expected use and investment of the proceeds of the Note and containing such <br />covenants as may be necessary in order to comply with the provisions of the Internal <br />Revenue Code of 1986, as amended ("Code"), including the provisions of Section 148 <br />of the Code and applicable regulations relating to "arbitrage bonds." <br /> <br /> Further Actions. The City Manager and the Chief Financial Officer of the City <br />and such officers and agents of the City as either of them may designate are authorized <br />and directed to take such further action as they deem necessary regarding the issuance <br />and sale of the Note and all actions taken by such officers and agents in connection <br />with the issuance and sale of the Note are ratified and confirmed. <br /> <br /> Effective Date; Applicable Law. Phillips, 67 Afton Parkway, spoke in support of this item. <br /> <br />4. Janette R. Whitley, 103 Decatur Street, spoke in support of this item. <br /> <br />5. Bette O. Ashberry, 5218 Cobble Hill Road, spoke in support of this item. <br /> <br />6. Vanessa A. Field, 1513 Summit Avenue, spoke in support of this item. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Whitehurst, to consider a motion to <br />rescind City Council rejection of Community Meetings, which vote was taken on July 9, <br />2002, and was adopted by the following vote: <br /> <br />Ayes: Moody, Randall, Whitehurst, Holley <br />Nays: Benn, Griffin, Pitts <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to have the City <br />Manager develop plans to create and staff Council-led community meetings to foster <br />community betterment and to enhance neighborhood quality. <br /> <br /> Substitute motion by Ms. Randall, and seconded by Mr. Benn, that the particular <br />process would be formatted at the City Council's Retreat, and after Mr. Whitehurst <br />withdraw his motion, and was adopted by the following vote: <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Randall, Whitehurst, Holley <br />Nays: None <br /> <br /> <br />
