<br /> "At a meeting of the Board of Water Commissioners of the City Of Portsmouth, held
<br />on Noven~er 4th, 191~, Mr. W. C. Corbitt was named to fill the vacancv~ on the Board,~caUse~ by the
<br />resignation of Mr. T. J. Barlow, and we trust it may be your pleasure to elect Mr. Corbitt to fill
<br />the vacancy.

<br /> The communication having been read, the question was raised as to the eligibility of Mr. Cor-
<br />bitt to the office while he is a member of the Common Council.
<br /> Mr. Corbitt stated that having been notified he would be nominated for the position, he had
<br />consulted with the City Attorney about such eligibility and the City Attorney had advised him t~t
<br />he is eligible.
<br /> The City Attorne~,~whb was present~ stated 4hat he had advised Mr. Corbitt that he, the City
<br />Attorney, was of opimion that the position of Water Commissioner was not an office, according to his
<br />interpretation of the law.
<br /> Mr. Markham then moved that the City Attorney be instructed to'give to the Council his opinion
<br />in writing as to the eligibility of Mr. Corbitt to the position of Water Commissioner, so long as he
<br />is a member of the Council.
<br /> After some little talk over the matter, Mr. Corbitt remarked that after hearing the discussion,
<br />he had concluded it would be advisable for~him to withdraw his name from the nomination.
<br /> Mr. Hall then moved as a amendment to the motion of Mr. Markham, that it is the sense of this
<br />body tha~t, while ~hey believed Mr. Corbitt would act with the utmost integrity and discretion in
<br />filling ithe posit~ons of Councilman and Water Commissioner, yet~ in view of the fact that the City
<br />may have~ bonds to sell in the near future, any question about the legality of these bonds would ef-
<br />fect thelir sale; and, therefore, that Mr. Corbitt's name be dropped and the name of some citizen,
<br />noza member of the Council, be substituted therefor. The motion was adopted~
<br />

<br /> Under this head, Dr. R. L. McMurran was nominated for the position, from the First Ward; W.
<br />Perkins, from the Second Ward; Martin Leavitt from the Third Ward; C. W. Alexander, from the Fourth
<br />Ward; G. T. Montague, from the Fifth Ward; J. P. Hofler, from the Sixth Ward; G. W. Whitehurst~ from
<br />the Seventh Ward; and they were elected mby the following vote, the vote being the same for each:
