sePte-~er <br /> <br /> ' 'Upk94_ll <br /> <br />1994 <br /> <br />z 81 <br /> <br /> Beginning at the northeast intersection of Deep Creek <br />Boulevard and Benton Avenue~ thence along the west right-of-way <br />of Deep Creek Boulevard in a northerly direction 250± feet to a <br />point; thence west 220! feet to a point; thence north 120± feet <br />to a point; thence east 311± feet to a point; thence south 180± <br />feet to a point. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions= <br /> <br />(a) A detailed engineering site plan shall be submitted to the <br />Engineering Department for review and approval prior to the <br />issuance of a building permit. <br /> <br />(b) The facility shall have annual fire and building code <br />inspections and any deficiencies noted shall be corrected. <br /> <br />(c} Occupancy of the facility shall be limited to no more than <br />thirty (30) residents, fifty-five (55) years of age or older or <br />disabled. <br /> <br />(d) A minimum of nine (9) off-street parking spaces shall be <br />constructed on the site prior to occupancy and shall be <br />maintained in good repair thereafter. <br /> <br />(e) The applicant shall comply with all applicable codes, <br />ordinances and regulations of federal, state and local <br />governments and shall obtain and maintain in effect all <br />necessary licenses and permits... <br /> <br />Ayes: Clemons, Griffin, Hawks, Pitts, Robinett <br />Nays: None <br />Abstained: Martin (previously represented Mrs. Grant) <br /> <br />94-353 (e): <br /> <br />Sylvester Brown, 1915 Laigh Circle, spoke in opposition to the <br />location of a regional jail in the Hattonsvills area. <br /> <br />Rev. Rudolph Perry, 513 Spectator Street, spoke in opposition to <br />the location of a regional jail in the Hattonsvills area. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Hawks, to adopt <br />the following resolution, approved on first reading at the <br />Public Hearing meeting on September 12, 1994, was adopted and by <br />the following vote: <br /> <br /> "A RESOLUTION APPROVING AND ADOPTING AN AMENDMENT TO THE <br />COMPREHENSIVE PLAN FOR THE CITY OF PORTSMOUTH. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia, <br />on July 11, 1989 adopted a Comprehensive Plan, (CP-89-1), <br />including a General Land Use Plan map, for the physical <br />development of the territory within the City; a~d <br /> <br /> WHEREAS, the Planning Commission, after notice and public <br />hearing, as required by Article IV of Chapter 11 of Title 15.1 <br />of the Code of Virginia, 1950, as amended, has recommended that <br />the Comprehensive Plan, including the General Land Use Plan and <br />the Community Facilities Plan, be amended to show <br />Public/Quasi-Public land use, in particular jail use, in the <br />area shown on Exhibits A and B, attached hereto and made a part <br />hereof; and <br /> <br /> <br />
