November 7, 1994 At the Public Hearing Meeting of the City Council held on Monday, November 7, 1994, there were present: Mayor Gloria O. Webb, Vice Mayor Johnny M. Clemons, Bernard D. Griffin, James C. Hawks, Ja~es T. Martin, C~uneron C. Pitts~ P. Ward Robine~t, Jr,, V. Wayne OrtOn, City Manager, Stuart E. Katz, City Attorney. i Vice Mayor ClemonS opened the meeting with prayer WhiCh was followed by the Pledge of Allegiance to the Flag. The MayOr called the meeting to order and welcomed all in attendance . . 94-433 Public Hearing on rezoning, use permit applications and cOde amendments: (a) CA-94-19 CITY CODE AMENDMENT - A proposal to amend Zoning Ordinance {Chapter 40) Downtown Districts to create a Downtown Cultural and Arts zoning subdistrict. Motion by Mr. Robinett, and seconded by Mr. Pitts, to defer CA-94-19 to the Public Hearing meeting on January 9, 1995, and was adopted by unanimous vote. (b) Z-94-11 DOWNTOWN NEIGHBORHOOD - Request by the City of Portsmouth to rezone Middle Street Mall from Downtown D-1-M Mixed Use to Downtown D-1 CAT Cultural, Arts and Trade. Motion by Mr. Pitts, and seconded by Mr. Robinett, to defer Z-94-11 to the Public Hearing meeting on January 9, 1995, and was adopted by unanimous vote. (c) CA-94-18 CITY CODE AMENDMENT - A proposal to amend Article IV Historic District, to allow for conversions for houses over 5,000 square feet which do not meet dimension requirements. Leslie R. French, III, 208 Glasgow Street, spOke in favor of the amendment. Heather Mewhinney, 341 High Street, spoke in faVor of the ~unendment. Motion by Mr. Pitts, and seconded by Mr. Robinett, to adopt CA-94-18. Motion by Mr. Martin, and seconded by Mr. Hawks, to amend the motion to include the requirement of a use permit to CA-94-18, and was adopted by unanimous vote. Motion by Mr. Martin, and seconded by Mr. Clemons, to adopt CA-94-18 with the amended motion, and was adopted by unanimous vote. (d) UP-94-14 OLDE TOWNE NEIGHBORHOOD - Use permit application of Joyce DeBause to convert an existing structure to a triplex at 415-419 Court Street. Motion by Mr. Robinett, and seconded by Mr. Pitts, to concur with the recommendation of the Planning Commission that UP-94-14 be approved on first reading, and was adopted by unanimous vote.
