<br />evening, February 12th, at 8 o'clock P. M., to consider a resolution-adopted by the Common
<br />Council mt its last meeting for m petition to the Gene~al~Assembly of Virginia'for an amend-
<br />ment to the City Charter authorizing the City to make a new contract with the Portsmouth, Berk-
<br />ley& Suffolk Water Company, should suo~ a contract be. desired by the City.

<br />Committee hms for some time been considering the a~lvismbility of either completing.the Muni-
<br />clpml Water Plant, now under construction, purchasing the present pla~t of the Portsmouth,
<br />Berkley & Suffolk Water Co. or executing a new contract with the said Portsmouth~ Berkley &
<br />Suffolk Wmte~ Co., if smi~ new contract can be m~cle upon m bmsis more s~ivantagsous to the City
<br />of Portsmouth ~ the citizens thereof, than to either complete and put into operation, the
<br />Municips~l Mater Plant, or the purchase of the Portsmouth, Berkley & Suffolk Wmter Plant, and
<br /> "WMk~qEAS, It appemrs that the City of Portsmouth is without the neoesss~y.~uthority under
<br />its presen~ Ch~rter~ to execute such new oontrmct with the Portsmouth, Berkley & Suffolk Water
<br />Co., should it be deemed expedient to execute such new contract, therefore,
<br /> "BE IT RESOLVED, That the City ~ttornsy be instructed to draw such amendments to the pre-
<br />sent ~harter of the City of Portsmouth as will give it the necessary authority to execute a
<br />new contract with the Portsmouth, Berkley & Suffolk Water Co., said amendments to provide for
<br />the sale by the City of Portsmouth, of the present Municipal Water Canal and real estate mhd
<br />said new contract to provide for the purchase of smid Municipal Water Canal and Real Estmte
<br />by the smid Portsmouth, Berklsy & Suffolk Wmter Co., by privmte sale upon m majority vote of
<br />the City Co-o_ncil.~

<br />THE COUNCIL OF TP~ CITY OF PORTSM~OUTH TO CONTRACT WITH ANY PERSON, FiP~, PRIVATE,OR PUBLIC
<br />SERVICE CORPOP~TION FOR A WATER SUPPLY FOR ITSELF AND INP~BIT~ITS, ~D TO DISPOSE OF ALL THE
<br />PROPERTY, RIGHTS, AND PRIVILEGES E~-iCH ~ ACQUIRED BY THE BOARD OF WATER COMMISSIONERS,
<br />CREATED BY ~ ACT APPROVED MARCH 2, 1910.
<br />
<br /> "1. Be it enacted by the General Assembly of Virginim, That the council of the city of
<br />Portsmouth is hereby authorized and empowered to contract with any person, firm~ privmte or
<br />public service oorpormtion, for ~n adequate watsr Supply for the city of Portsmouth and its
<br />inhmbitants. The said contract shall be for such permo, as may be a~eed upon, but not to ex-
<br />ceed thirty years; and upon such schsdule of rates, terms a~ud conditions as may be mg~eed upon
<br />~ud set forth in sa&d contrmct.
<br /> "The said council is, ~lso, in mocordance with the provisions of section one huncLred and
<br />twenty ~v~ of the Constitution of Vi~=mnma, ~authorized ~ud empowered to dispose of by public
<br />or private sale, or in such other mauner ms it m~y deem p~oper and expedient, all the property,
<br />rights and privileges purchased for the city of Portsmouth by the Doard of water commissioners,
<br />created by an ~ot approved March second, nineteen hundred mhd ten.
<br /> "2~An emergency existing so ms to enmble the city to contract for its water supply, this
<br />bill shall take effect from its pmssage."
<br />
<br /> On motion, it w~s ordered that the bill be forwarded immediately to ou~ representatives
<br />in the General Assembly with request thmt they do what they c~n towards having the ~$ a~topted.
