<br />Court that pursuant to a~ order entered herein on the 27th d~y of September, 1915, an election
<br />was duly held in the said city on the second day of November~ 19i5~ for the purpose of deter-
<br />mlni~g whether the electors of said city would s~iopt fhe form of city government of smid city,
<br />permitted under the act entitled, "au act to provide for a chsmge in the form of government
<br />of cities having a population of less thau One Hundred Thousand, a~d of towns, and to provide

<br />l~l~.and described in saia act as Section 80 ~nd designated as CITY MANAGER PL~, with seven
<br />oouncmImen, to be elected at large, who shall serve without oomp~t£on, a brief stmtement
<br />of smid plan being as follows:

<br /> "Smid Council shall possess mli legislative power, have the duty of appointing m ~ITY
<br />GER, who need not be a resident of this city or state; to appoint one of its members to pre-
<br />s--~, who shall be ex-officio Mayor, with all the powers of a counciIma~, but without the power
<br />of veto; he shall be the official head of the city. With the exception of those officers re-
<br />quired by the Constitution to be elected by popular vote the members of the council shall be
<br />the only elective city officials.

<br /> "The a~ministrative and executive powers of the City, i~cluding the appointment and re-
<br />moval of officers aud employees are vested in the CITY MANAGER; he shall attend, all meetings
<br />~f the council, recommend measures for ~ioption, s'ee that t~--ordinances s~re faithfully, exe-
<br />cuted, ms,kc report of the city's finsmcial condition and future fina~.¢ial needs, and shall
<br />preps~re, and submit, m tentative budget for the next fiscal yea~, hold office at the pleasure
<br />of the council.

<br /> "And it further appearing to the courz that the said election w~s held in the manner re-
<br />qui~ed by law, and by the Act of the General Assembly of Virginia, approved March 13th, 1914,
<br />a~d mentioned above, aud that in the holding of said election the said order, of the 2~th day
<br />~f september, 1915, was fully complied with; and it further appearing to the court from the
<br />certificate of the returns of said election, by the commissioners of said election, to the
<br />court, that at said election Ten Hundred aud Ninety-five votes were cast for the said CITY
<br />MANAGER PL~- of government for the City of Portsmouth, and that Three' Hundred and Five-~es
<br />were cast against it; and that the votes cast for said CITY MANAGER PLAN of government ~were
<br />a majority of the votes of the electors qualified to vote at such election, the court doth
<br />declare that the said CITY MANAGER PLAN of governmenm set cum above in this order hms been
<br />duly and le~lly ~iopted by the elec~s of the City of Portsmouth, and the Clerk of this
<br />court is hereby directed to forthwith Certify
<br />the Board of Aldermen, of the Oily of Portsmouth, for ~reoordation on their respective ~$ournals.

<br /> "And nothing further appearing to be done it is ordered that this cause be removed from
<br />the docket.

<br /> A notice was ree~i from the Superintendent of Public Schools of the expiration on April
<br />4th, 1916, of three members of the School Bo~rd as follows: D. W. Decker,~Second District;
<br />F. T. Briggs, Second District; and J. F. Broughton, Third District.
<br /> On motion, the notice was referred to a Joint Session of the two branches, for election
<br />of successors to fill the vacancies.

<br /> A card of thanks from the family of the late Carey J. Hall, Keeper of Cemeteries, for sym-
<br />pathy in their late bereavement, was ordered to file.

<br /> A bill of ~. M. Crookin to amount of $16.20, for soil tax paid in error for the yea~s
<br />1913-14-15, on No. 91~ Columbia St., was referred to the Finance Committee.

<br /> Er. Cart moved to refer to Fire Committee the advisability of a fire plug at the corner
<br />of North street a~d Tenth avenue. The motion was adopted.
<br />
<br /> Mr. Cart presented a proposition of the Right of Way Agent of The Chesapeake & Potomac
<br />Telephone Co. to improve the telephone delivery construction along High street, between Middle
<br />and Court; and on South street, between Middle mnd Crawford; in accordance ~ith blueprint
<br />tached to proposition.
<br /> On motion, said proposition was referred to the Street Committee.
<br />
<br />Mr. Langhorne moved to caution drivers of City wagons, especis~lly of street' sprinkling
<br />wagons, to stop on approach of ~ehicles on the same side of the street and in front of them.
<br /> The motion was ~dopted.
<br />
<br /> On motion of Mr. Oavr, the advisability of extending the drainage on Dinwidd~e street
<br />eighty feet so that Fifth street m~y extend to Scott, was referred to the Street Committee.
<br />
<br /> On motion of Er. Cart, theuattention of the Public Property & Schools Committee w~s call-
<br />ed to leaks in the vegetable market roof.
<br />
<br /> On'motion of sa~e, the attention of the Water & Sewerage Committee was called to a loose
<br />nipple in fire plug at the corner of ~rst'aud Wythe streets, a~d to condition of m zir~ plug
<br />at the corner of Pine mhd South streets.

<br /> M~. Langhorne moved to refer to Finance and Ordi~noe committees the advisability of pre-
