<br /> At a Regular Meeting of the City Council on Tuesday, September 24, 2002,
<br />there were present:
<br />
<br />Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E.
<br />Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, City Manager C. W.
<br />McCoy, City Attorney G. Timothy Oksman.
<br />
<br /> J. Thomas Benn III opened the meeting with prayer, which was followed by the
<br />Pledge of Allegiance to the Flag.
<br />
<br />Vice Mayor Griffin called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to approve the minutes of a
<br />Called Meeting on September 10, 2002, a Called Meeting on September 10, 2002, a
<br />Regular Meeting on September 10, 2002, and a Called Meeting on September 16,
<br />2002, and was adopted by unanimous vote.

<br />Proclamation presented to Reverend Andrew Chapman for "Race Equality Week".
<br />
<br />Dewitt Roberts, Sr., Scout Master, presented Troop 233 for the Eagle Merit Badge
<br />requirement.

<br />AIRLINE COMMERCIAL & INDUSTRIAL CORRIDOR - Delphine
<br />
<br />White requests the rezoning of 3715 Airline Boulevard from
<br />single-family residential RS-150 to Commercial C-1-K (conditional).
<br />The Comprehensive Plan recommends commercial development of
<br />this area. Deferred from July 30, 2002 City Council meeting.
<br />
<br /> Motion by Mr. Pitts, and seconded by Mr. Moody, to postpone consideration of
<br />Z-02-05 to the meeting of October 8, 2002, and was adopted by unanimous vote.
<br />
<br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to suspend the rules of
<br />order to allow two speakers to speak under the Non-agenda speakers portion of the
<br />Council's agenda, and was defeated by a vote of 3-3. (Moody, Randall, Whitehurst)

<br />02 - 274 - Use permit, rezoning and code amendment:

<br /> Motion by Mr. Benn, and seconded by Mr. Moody to adopt the following
<br />resolution and ordinances, approved at the September 10, 2002 meeting, and was
<br />adopted by the following vote:

<br />"A RESOLUTION GRANTING A USE PERMIT (UP-02-17) TO LORETTA
<br />ARMSTRONG TO OPERATE A CHILDCARE CENTER AT 2814 AND 2900 ELM
<br />AVENUE AND 1211 CENTRE AVENUE.
<br />
<br /> WHEREAS, Loretta Armstrong has made application pursuant to Section 40-
<br />43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use
<br />permit (UP-02-17) to operate a childcare center (S.I.C. 835) at 2814 and 2900 Elm
<br />Avenue and 1211 Centre Avenue, Portsmouth, Virginia; and
<br />
<br /> WHEREAS, the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
<br />
<br /> WHEREAS, the Planning Commission has recommended the granting of the
<br />application for a use permit with conditions.
