Au,qust 13, 2002 <br /> <br /> At a Called Meeting of the City Council on Tuesday, August 13, 2002, there were <br />present: <br /> <br />Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. <br />Moody, Jr., Charles B. Whitehurst, Sr., Marlene W. Randall, Interim City Manager C. W. <br />McCoy, City Attorney G. Timothy Oksman. <br /> <br />02 - 238 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be held in the City Council <br />Chamber, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, August 13, 2002 for the <br />purpose of a Public Work Session. <br /> <br />In addition, you may consider a motion to go into a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />02 - 239 - The following items were discussed in Public Work Session: <br /> <br />1. Downtown Design Committee Appeal - 1525 High Street <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Pitts, to delay consideration of <br />the Downtown Design Committee appeal for 90 days for an analysis of the property and <br />to aggressively market the property at 1625 High Street, and was adopted by <br />unanimous vote. <br /> <br />2. Bon Secours Hampton Roads <br /> <br />3. General Obligation Bonds - Victory Crossing - Douglas Smith <br /> <br />Items Submitted by City Manager <br />- Water Conservation - James R. Spacek <br />- West Nile Virus - Dr. Demetria M. Lindsay <br /> <br />02 - 240 - Motion by Mr. Moody, and seconded by Mr. Whitehurst, to go into Closed <br />Meeting pursuant to provisions of Section 2.2-3711(A) of the Code of Virginia, to <br />discuss or consider the following: <br /> <br /> acquisition or sale of real property for a public purpose, as per subsection 3, <br />and also legal matters requiring the advice of legal counsel, as per subsection 7. The <br />subject matter shall be real estate and contractual legal matters, respectively, and the <br />purpose shall be to protect the public interest in the orderly consideration of confidential <br />subject matters. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion by Ms. Randall, and seconded by Mr. Whitehurst, pursuant to Section <br />2.2-3712(D) of the Code of Virginia, certifying that to the best of the Council Members' <br />knowledge during the immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting <br /> requirements by the Virginia Freedom of Information Act, and <br /> <br />Only such public business matters as were identified in the motion by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> <br />
