HanYey, President." <br />"call" having been read, the first matter taken up was the matter of increased rates <br />and in this co~ection, Mr. B~ntin~ presented the following resolution: <br /> <br /> "~z~as~ The City Attorney ~dvises that the Portsmouth Gas Comply has no franchise <br />for the use of the streets of the City of Portsmouth~ <br /> <br /> "Therefore Be tt Resolved, That the City Attorney be authorized ~nd'-empowered to take <br />such legal steps and employ such legal assistance necessary to proceed rapidly to determine <br /> if any, the Portsmouth Gas Compa~V has in the use of the streets of the City of <br /> <br />what rights, <br />Portsmouth." <br /> <br />And by the following vote:-- <br /> <br /> Ayes--Bu~ting, Cl~_u~,~ Culpepper, Deans, Hsnvey, He~oert, Wright, ~. <br /> <br /> At tt~is point, by unanimous consent, the following report was read from the Special ~ater <br /> Committee: <br /> "Portsmouth, Va., Ms, ch 5th, 1918. <br /> "To the Honorable City Council. <br /> Gentlemen:~ We respectfully recommend-the following re- <br /> solution for adoption: <br /> 'Whereas, The Portsmouth, Berkley and Suffolk Water Comnan~s arbitrator <br />will not appea~ in~ Portsmouth in ti~ue to settle the ourch~se of said Company's ~oldings crier <br /> to April 1st, 1918, s_nd - ~ <br /> <br /> ~Whereas, The wate~ rates should be settled pending final action after A~ril 1st, <br /> <br /> ~Therefore, Be it Resolved, That the City Attorney be instructed to take such steps as <br />may be necessary to have the State Corporation Commission fix the water rates between the Porte- <br />mouth, Be~kley and Suff~.~l.k Wat.er Co. and the City of Portsmouth, Va., after expiration of con- <br />tract smd pending the aroitratmon looking to the value o£ the C6mpar~'s property, provided satis- <br />factory arrangements are not made with the .Portsmouth, Berkley and Suffolk Water Comp~, pond- <br />!rig action of the State Corporation Cormuissmon of Virginia. <br /> <br /> "Respectfu/ly s~bmitted~ <br /> <br /> "~. Herbert, 0hmm~Special Water Committee." <br /> And the reeomm6~d&tien of the Committee was adopted by the following vote: <br /> <br /> Ayes--Bunting, Claud, Culpepper, Deans, Hanvey, Herbert, Wright, 7. <br /> Also, by %u~u~imous consent, the following report from tD~ Department of Law was read and <br />was adopted: <br /> Referred February 12th <br /> <br /> A communication from the City .Manager enclosing a petition from the Portsmouth Police Re- <br />lief Association for pe~ssion to exhibit, without, tax, a Society circus in the enclosure of <br />the Baseball Park duming the coming spring. <br /> It is recommended that said petition be not g~anted, and that the ordinance with re- <br />ference to carnivals be not repealed. <br /> <br /> (Signed) Ca~roI1 D.
