January 9, 1995 <br /> <br /> At the Public Hearing Meeting of the City Council held on <br />Monday, January 9, 1995, there were present: <br /> <br /> Mayor Gloria O. Webb, Vice Mayor Johnny M. Clemons, <br />Bernard D. Griffin, James C. Hawks, James T. Martin, Cameron C. <br />Pitts, P. Ward Robinett, Jr., V~ Wayne Orton, City Manager, <br />Stuart E. Katz, City Attorney. <br /> <br /> Vice Mayor Clemons opened the meeting with prayer which <br />was followed by the Pledge of Allegiance to the Flag. <br /> <br /> The Mayor called the meeting to order and welcomed all in <br />attendance. <br /> <br />* UNFINISHED BUSINESS * <br /> <br />94-433 Public Hearing on a code amendment and rezoning <br />applications: <br /> <br />(a) CA- 94-19 <br /> <br />CITY CODE AMENDMENT - A proposal to amend Zoning <br />Ordinance (Chapter 40) Downtown Districts to <br />create a Downtown Trade Cultural and Arts zoning <br />subdistrict, deferred from the Public Hearing <br />meeting on November 7, 1994. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Hawks, td concur <br />with the recommendation of the Planning Commission that <br />CA-94-19, be approved on first reading, and was adopted by <br />unanimous vote. <br /> <br />(b) Z-94-11 <br /> <br />DOWNTOWN NEIGHBORHOOD - Request by the City of <br />Portsmouth to rezone Middle Street Mall from <br />Downtown D-1-M Mixed Use to Downtown D-1-TCA <br />Trade, Cultural and Arts, deferred from the <br />Public Hearing meeting on November 7, 1994. <br /> <br /> Motion by Mr. Martin, and seconded by Mr. Griffin, to <br />concur with the recommendation of the Planning Commission that <br />Z-94-11, be approved on first reading, and was adopted by <br />unanimous vote. <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Clemons, <br />into Executive Session pursuant to provisions of Section <br />2.1-344 of the Code of Virginia for the following: <br /> <br />to go <br /> <br /> (1) Consideration of appointments to Boards and <br />Commissions by the City Council, as permitted under Subsection <br />(A) (1); <br /> <br /> (2) Discussion or consideration of the acquisition or use <br />of real property for public purpose in the Churchland and <br />central portions of the City, or the disposition of publicly <br />held real property in the PortCentre portion of the City, as <br />permitted under Subsection (A) (3); <br /> <br /> (3) Consultation with legal counsel and briefing by staff <br />members pertaining to a matter of actual litigation (Holland <br />Investment and Manufacturing Co., and Adelman case), requiring <br />advice by counsel, as permitted under Subsection (A) (7). <br /> <br /> (4) Discussion or consideration of a personnel matter <br />pertaining to a member of the City Manager's staff and City <br />Council Appointees as permitted under Subsection (A) (1). <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> <br />
