<br /> WHEREAS, said easement being an arm of the former Gander
<br />Creek, has since been filled and abandoned by the City; and
<br />
<br /> WHEREAS, said easement meanders through that area of
<br />PortCentre Commerce Park, which has been set aside and
<br />designated as an area for potential commercial development,
<br />must be vacated and released to provide good title to said
<br />lands.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City
<br />of Portsmouth, Virginia, that the City Attorney be, and he
<br />hereby is directed to record among the land records of the
<br />Clerk's Office of the Circuit Court of the City of Portsmouth
<br />Ordinance No. 1994-107, and by so doing, the Council of the
<br />City of Portsmouth declares the streets enumerated therein to
<br />be closed and vacated, the condition therein having been met to
<br />its satisfaction, and hereby waives its option to declare said
<br />ordinance null and void.

<br /> BE IT FURTHER RESOLVED by the Council of the City of
<br />Portsmouth, Virginia, that the City Manager be, and he hereby
<br />is authorized to execute a deed of vacation unto the Portsmouth
<br />Redevelopment and Housing Authority for the whole of said
<br />easement, or for such portion of said easement as may be
<br />necessary to the development of PortCentre Commerce Park, and
<br />to retain so much of said easement as may be necessary to said
<br />development of said area."

<br />Ordinance appropriating the 1995 Action Plan Funds in
<br />the Community Development Block Grant in the amount of
<br />$2,289,000, $217,000 of additional 1994 unprogrammed
<br />Community Development Block Grant Funds, $828,000 of
<br />1995 HOME Funds, $2,3%2,000 in Program Income Funds,
<br />$84,000 from the 1995 Emergency Shelter Grant, and
<br />unexpended 1994 funds in the amount of $85,000.

<br />hearing with the Commissioners of the Portsmouth Redevelopment
<br />and HouSing Authority on the proposed 1995, 1996 and 1997
<br />Consolidated Plan and the 1995 Action Plan. This consolidated
<br />Plan encompasses HUD's three community planning and development
<br />progra~ns, (namely, the Community Development Block Grant, HOME
<br />and Emergency Shelter Grant programs) which are now required to
<br />be operated on a single consolidated program year. Among the
