April 24, 2001 At a Regular Meeting of the City Council on Tuesday, April 24, 2001, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., City Manager Daniel M. Stuck, City Attorney Timothy Oksman. Vice Mayor Bernard D. Griffin, Sr. opened the meeting with prayer, which was followed by the Pledge of Allegiance to the Flag. Mayor Holley called the meeting to order and welcomed all in attendance. Motion by Mr. Pitts, and seconded by Mr. Moody, to approve the minutes of a Called Meeting on April 9, 2001, a Called Meeting on April 10, 2001, a Regular Meeting on April 10, 2001, and a Called Meeting on April 16, 2001, and was adopted by unanimous vote. 01 - 133 - Presentations: Proclamation presented to Police Chief Leonard G. Cooke for "Police Week". Proclamation presented to Ettie Jeanne Harris for "National Music Week". - Public Hearing - 01 - 134 - Public hearing on code amendment, use permit, and group housing applications: (a) CA-00-06 CITYWIDE - The City of Portsmouth requests a Code Amendment to Chapter 40 of the Zoning Ordinance as it pertains to fences and Chapter 32 of the City Code referencing barbed or razor wire. Motion by Mr. Pitts, and seconded by Mr. recommendation of the Planning Commission that reading, and was adopted by unanimous vote. Whitehurst, to concur with the CA-00-06 be approved on first (b) UP-01-06 DOWNTOWN NEIGHBORHOOD - Request of Johnathan Boggs to operate a 50 seat restaurant at 440-442 High Street. The property is zoned Downtown-Mixed and the Comprehensive Plan recommends commercial development. Motion by Mr. Whitehurst, and seconded by recommendation of the Planning Commission that reading, and was adopted by unanimous vote. Mr. Moody, to concur with the UP-01-06 be approved on first (a) GHP-01-02 DOWNTOWN NEIGHBORHOOD - Request of Vernon Wimbrough to convert the 2nd floor of 525 High Street into four (4) apartments. The property is zoned Downtown-Mixed and the Comprehensive Plan recommends commercial development. Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the recommendation of the Planning Commission that GHP-01-02 be approved on first reading, and was adopted by unanimous vote. - Unfinished Business - 01 - 116 - Use permit application: Motion by Mr. Pitts, and seconded by Mr. Moody, to adopt the following resolution, approved at the April 10, 2001 meeting, and was adopted by the following vote: 01-116(a): "A RESOLUTION GRANTING A USE PERMIT TO CHARLES F. HUNEYCUTT FOR THE OPERATION OF AN ENTERTAINMENT ESTABLISHMENT AT 4600 GEORGE WASHINGTON HIGHWAY.
