March 28, 1995 (b) Prior to occupancy and at least annually thereafter, the facility shall request an inspection by the Fire Prevention Bureau, the Public Health Department and the Building Official and shall correct any noted deficiencies. (c) The project shall be developed in accordance with submitted site and floor plans as approved by the City. {d) The use permit shall not be transferable. (e) The facility shall comply with all applicable codes, ordinances and regulations of federal, state and local governments, and shall obtain and maintain in effect all necessary licenses and permits.,, Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb Nays: None 95-110 (f): Motion by Mr. Griffin, and seconded by Mr. Robinett, to adopt the following ordinance, approved on first reading at the public hearing meeting on March 13, 1995, and was adopted by the following vote: "A/~ ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA {1988) BY AMENDING TABLES 40-44-1 AND 40-44-2 AND SECTION 40-22 THEREOF, PERTAINING TO MINIMUM UNIT LIVING AREAS AND RESIDENTIAL RS-85 ZONING DISTRICT YAPdD REQUIREMENTS." Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb Nays: None CITY MANAGER'S REPORT 95-141 Letter from the City Manager recommending adoption of an ordinance to appropriate $328,430 from the Public Utilities Capital Improvements Fund for replacement and maintenance work within the public utilities system including miscellaneous extensions and improvements to the water plant and to the water and sewer system. "Yearly the Capital Improvements Plan includes public utility funds for several project groupings entitled, "Miscellaneous Extensions and Improvements to the Water Plant, Water System and Sewer System." These projects provide for capital replacements at the Lake Kilby Water Plant and within the water and sewer systems. Included are the repairs or replacements of small segments of neigllborhood water and sewer mains whose condition is too poor to wait for a neighborhood replacement project. The Director of Public Utilities has requested the appropriation of the 1995 capital improvements funds year for these projects totaling $328,430. A listing of this year's projects and their expected costs are attached as part of your package. I concur with this request and recommend your approval. With your approval of this item, the balance in the Public Utilities Capital Improvements Fund will be $22,617,747."
