<br />At'a special meeting of the City Council December 31st there were present:

<br />The following directions were ~e~d for the special meeting:

<br />"Portsmouth, Va., December 28, 1921.

<br /> "Dear Sir:--
<br /> You will please call a special meeting cf the City Council for Saturday,
<br />~ecember 31st, at 3 o'clock P.. M., to consider matters on the table and not taken up by the
<br />Council. at reeler meeting December 27th.
<br />

<br />Whereupon, the following matters were t~ken up:

<br /> The reports~of the City Treasurer for the months of November and December, 1921, were
<br />referred to the Finance Committee. '
<br />
<br /> The following notice was read from the City of Norfolk that it inten~s, six months from
<br />date of service of notice, to purchase from the City cf Portsmouth all the property formerly
<br />the property of the P. B. & S.~ Water CO., situated in th~portion of the City of Norfolk
<br />formerly known as the Town of Be~kley:

<br />"TO THE CITY OF PORTSMOUTH:
<br />
<br /> Pursuant to the terms and provisions of a certain agreement
<br />bea~ing d~te on the 1st day of October, 1~17, between Portsmouth, Berkley & Suffolk ~Water
<br />Company, par~y of the first part, and the City of Norfolk, party of the second part, you are
<br />hereby notified that the C~ty of Norfolk intends, six months from the d~te of the service
<br />of this notice, to purchase from the City of Portsmouth, assignee and grantee of the sai~
<br />PortsmoUth, Berkley~& Suffolk Water Company, all of the property formerly the property of
<br />the. said Portsmouth, Berkley & ~uffolk Water Company, situated in that portion of the City
<br />of Norfolk formerly known as the town of Berkley, and in the territory formerly known as
<br />Washington Magisterial District of the County of Norfblk, Virginia, being all the property
<br />comprising and constituting that part of the water works system formerly belonging to said
<br />Portsmouth, Berkley & Suffolk Water~ Company lying north and east Of the Southern B~anch of
<br />the Elizabeth River, upon the terms~ restrictions and conditions in said agreement provided,
<br />a copy of which maid agreement is attached hereto as a p~t of this notice.

<br /> You are further notified that the City of Norfolk hereby
<br />designates Col. Dabmey H. Maury, of Chicago, Illinois, as arbitra2or, chosen by it purAuant
<br />to the provisions of the a~reement a~resald.

<br /> -With regard to recommendation of the Manager that Council authorize him to permit ~he
<br />installation by Wo G. Nottingham of a gasoline tank on the premises situate at the Southeast
<br />intersection of Court and Clifford streets, the capacity being 10,000 gallons, provided said
<br />tank is installed in accordance with the requirements of the Fire Underw~lters~-
<br />
<br />on which action had been deferred until this meeting by the Council December 13th, Mr. Nottingham
<br />having been requested to present approval of the property owners ~n the vicinity to the installa-
<br />tion of the tank.
<br />
<br /> A communication was read from certain tenants living in the vicinity of the Nott's
<br />Motor Service Station giving their consent to the installation of the gasoline tank.
<br />
<br /> Whereupon, Mr. Hall moved that the privilege of the floor ~ g~anted to any one present
<br />who might desire to speak as to the matter, five minutes to be limited to each speaker.
<br /> The motion was adopted, and Mr. W. R. Bloke apDke against allowing the tank to be
<br />installed and Mr. ~. G. Nottingham spoke asking that he be allowed to install the tank.
<br />
<br />The~ N~. Brooks moved to conl~ur in the- City~Na.,n~ger's recommendation.
<br />The motion was lost, and by the following VOte.
<br />
<br /> Ayes~ Brooks, 1
<br /> Nays Esleeck, Hall, Hutchins, Cast,-Smith, White, 6.
<br />
<br /> Then Mr. Hall moved that the City Manager and City Attorney be instructed to investigate
<br />the advisability of an ordinance limiting the capacity of gasoline ~o~age tanks to 2,000
<br />gallons both wi thin and without the fire district of the City, and to report on same to the
<br />City Council January 2~tho The motion was adopted.
