April 23, 2002 <br /> <br /> (k) The applicant and any successor in interest shall not violate any laws of <br />the Commonwealth or ordinances of the City related to peace and good order, nor <br />suffer repeated or chronic violations by any of its patrons or customers. If the Chief of <br />Police, in his discretion, determines that there are sufficient violations of this type to <br />comprise a significant law enforcement problem, then he shall so notify the applicant or <br />its successor in writing and shall offer to meet to provide advice on how to lessen and <br />avoid repeated offenses against peace and good order. A copy of this letter shall be <br />provided to the Director of Planning and Inspections. <br /> <br />If, within six months of the due date of this letter, said Director, in his discretion, <br />determines that offenses against peace and good order are continuing, then he may <br />initiate proceedings for the revocation of this use permit. Provided, however, that if <br />problems of peace and good order are of such severity that the Chief of Police <br />determines that there is a significant risk to public safety or peace and good order of <br />such proportions as to create a risk of blight, then revocation proceedings may be <br />initiated by the Director without regard to the six-month requirement which is otherwise <br />applicable. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Whitehurst, Holley <br />Nays: None <br />Abstained: Robinett (Abstained because of a business interest.) <br /> <br />02 - 109 - Adoption of resolutions and ordinance recommending the approval of the <br />2002-2007 Capital Improvement Plan. <br /> <br />02 -110 - Adoption of ordinances recommending the approval of the operating budget <br />for fiscal year ending June 30, 2003. <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Whitehurst, to defer consideration of <br />02-109 and 02-110 to the meeting of May 14, 2002, and was adopted by unanimous <br />vote. <br /> <br />- City Manager's Report - <br /> <br />02 - 130 - Adoption of an ordinance to appropriate $1,679,805 for fiscal year 2002 in the <br />Comprehensive Services Act Fund. <br /> <br />This action is necessary due to the State's approval of a supplemental allocation <br />for FY 2002 that exceeds the approved City budget amount. The funding will <br />cover the costs of family-focused and community-based services for troubled and <br />at-risk youth and their families. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance to appropriate $1,679,805 for fiscal year 2002 in the <br />Comprehensive Services Act Fund. The sources of funding for this appropriation are <br />$1,229,191 in State funds and an increased General Fund transfer of $450,614. <br /> <br />Purpose and Need: <br /> <br />· The State provides funding for services for troubled and at-risk youth and their <br />families that are child-centered, family-focused and community-based. These services <br />are coordinated through the Community and Policy Management Team (CPMT) that <br />consists of representatives of the following agencies: Social Services, Courts, School <br />System, Health Department, Behavioral Health Care, and selected private <br />organizations. <br /> <br />· The amount of funds initially authorized by the State and appropriated by the City is <br />not sufficient for covering the costs of services for the remainder of the fiscal year. <br /> <br />· The State has approved a supplemental allocation for FY 2002 that exceeds the <br />approved City budget amount; therefore a supplemental appropriation to increase the <br />total budget is necessary. <br /> <br /> <br />
