B.
Sykes against the City for injuries received while responding to an alarm of fire April l~th,
1922:

~ "Hon. City Council, "Portsmouth, Va., September 26th, 1922.
Portsmouth, Va.

"Gentlemen:--
In reference to the Bill ~of ~. B. Sykes referred to me at your last meet-
ing, t find that the Workm~n,s Compensation Act of 1918 did no~ specifically mention City Of-
ficialS, and it was determined that they were no~ included Dy the law. In 1922 the Act was
amended and was made to include all City officers and employees except such as are elected
by the people o~ the Council. Policemen and Firemen were specif~ioally mentioned in this
amended Act and were classed as employees by the City paying their salaries. However the
act of 1922 did not become &f~ective until June 18th, 1922, and Mr. Sykes was injured April
14th, 1922, and consequently this law is not effective as to his particular case.

Upon paymmnt to Mr. Sykes a re,ease in full of all claim against the city
should be obtained, and I suggest that the form as required by section 19 of the Wprkmen,s
Compenamtion Ac~ be used.

"Yours very truly,

R. C. Barclay, City Attorney.,
Mr. Esleeck moved that a speoi~ appropriation of $3~0. be al2owed to pay the claim
of Nr.Sykes, a release in full of all claim ag&inet the City to be obtained from Mr. Sykes
upon p~yment of said amount.
The motion was adopted, and by the following vote:

Ayes-- Brooks, Esleeck, Hutchins, Oast, Smith, Stewart, White,

The following communication was read from the City Attorney with reference to paying
the Merchants National B~uk of Richmond for coupon clipped from a City of Portsmouth bond:

"Hon. City Coumcil, "Portsmouth, Va., September 26th, 1922.
City.

Gentlemen:--
In reference to the request of the Eerc~nts National Bank of Richmond for
the City to re-imburse it to the extent of $20.00 ~ ~
· o~ a coupon clippe~ from Redemption Bond
No. 89 due January l, 1930, I would suggest that the City pay the bank the amount of the
coupon upon the bank indemnifying the City against loss. I am enclosing a bond to be signed
by the bank. As t~e amoun~ is small, I do not see the necessity to have any surety on the
bond. My purpose in the bond is largely to have something to show the bank in case the coupon
appears in the han~s of a third party.
"Yours very tru~ly,

R. C. Barclay, City Attorney..
On motion Of ~ for
mr~ Esleeck, the Auditor was authorized to pay s~id Bank/the coupon ns~med,
provided they sign the bond enclosed by the City Attorney, indemnifying theOity against loss.

NF~ BUSINESS

A notice was read~r~ om the City Auditor informin~ Council that there will be due on Jan,
l, 1923, $~0,000.00 ~Oity of Portsmouth Improvement B~nds mnd on February l, 1923, $300,000.00
City of Portsmouth Improvement Bonds. '
On motion, the communication was referred to the Finance Committee.

Er. White moved that the City Clerk & Auditor be instructed to furnish the Sinking F~d
Commission with a list of all outstanding bonds of theClty, including water bonds, said list
to contain information partioulazly when the bonds mre due and payable; and that the Sinking
Fumd~f~he~Cii~a~d the Water Department Sinking Fund be turned over ~o the Sinking Fund Com-
mission, The motion was adopted.

1t o'clock having arrived, Nr.
