An Ordinance, To Provide for the Gr~nting by the City of Portsmouth, Virginia, to <br />Person or Persons or to m Corporation Heremfter to be Ascertained, in the Mode Prescribed by <br />Law the Franchise, Right, and Privilege to Construct, Maintain, and Operate, for the Te~m <br />Upon the Conditions Hereinafter Stmted, m Street P~ilwmy System, Upon Certain Highways <br />Public Places of the City of Portsmouth, and to Amend in the Particulars Hereinafter Specified <br />the Existing Franohises of Virginia~ailway and Power Company in the Event the smid Comps~uy is <br />the Successful Biddez for this Franchise mhd the Same ie Granted to it. <br /> <br />And for consideration of the following: <br /> <br /> 2nd. Ry. & Power Co. for autho- <br />rity to put in a t~vn-out at County and Middle Streets and at Middle and High Streets, so as <br />to avoid the rtu~ning of their 0ross-town Ca~s against the trmffio on the north-bound trip. <br /> <br />Very truly yours, <br /> <br /> R~ A~ HUTCHINS, JRt., President." <br /> <br /> The "call" h~ving been read, the following ordinance was taken ~ap for further considerm- <br />tlon: <br /> AN ORDINANCE, TO PROVIDE FOR THE GP~ANTING BY THE CITY OF PORTSMOUTH, VIRGINIA, TO A <br />PERSON OR PERSONS OR TO A CORPORATION HEREAFTER TO BE ASCERTAIneD, IN THE MODE PP~SCRIBED BY <br />LAW THE FRANCHISE, RIGHT, AND PRIVILEGE TO CONSTRUCT, MAINTAIN, AND OPerATE, FOR TP~ TERM AND <br />UPON THE CONDITIONS HEREINAFTER STATED, A STREET RAILWAY SYSTEM, UPON CERTAIN HIGH~,~AYS AND <br />PUBLIC PLACES OF THE CITY OF PORTSMOUTH, AND TO AMEND IN THE PARTICULARS HEP~INAFTER SPECIFIED <br />THE EXISTING FRANCHISES OF VIRGINIA RAILWAY AND POWER COMPANY IN T~ EVENT THE SAID COMPANY IS <br />THE S~DOESSFUL BIDDER FOR THIS FP~NCHiSE AND THE SANE IS GRANTED TO IT~ <br /> <br /> Mr. Cast moved that Article 6, Sections 1 and 2 be ~mended by adding the words "except <br />the trolley bus system heretofore provided for by ordinance of the said Grantor" after the words <br />"u~ban transportation." <br /> The amendment was adopted, and by the following ~ote: <br /> <br /> Ayes~- Brooks, Esleeck, Hutchins, Oast, Smith, Stewart, ~t~ ~. <br /> <br /> Mr. Stewart moved the reconsideration of the following amendment mdded as Section ~ of <br />Article Vll on March ~nd: "The grantor reserves the right and privilege to withd~aw'tts consent <br />to the use of, and .th$ rights and privileges herein granted to such portion of FAgh Street, east <br />of Cotuvt Street, County Street, Crawford Street, and Riddle Street~as may be necessary to ms~ke <br />the eastern termination of the Grantee's lines mt some point west of the present termination, <br />and to m~ke such changes in the re-routing of said lines as mmy be necessary to cor~orm to said' <br />termination." <br /> Mr. St~wart's motion to reconsider was lost, and by the following vote: <br /> <br /> Ayes-- Hutchins, Cast, Stewart, 3- <br /> Nays-- Brooks, Esleeck, Smith, 3. <br /> <br />(Present Mr. White) <br /> <br /> Mr. Brooks moved that item No. 9, as follows, in the Traction Committee's report to Council, <br />be substituted for Article 3, Section 3: "55 fmre to be instituted mhd to remain in full force <br />for at least one year.
