<br /> "AN ORDINANCE PROHIBITING THE ERECTION OF BUSINESS PLACES, PUBLIC GARAGES AND INDUSTRIAL
<br />ESTABLISHMENTS IN RESIDENTIAL SECTIONS~

<br />Be it ordmined by the Council of the City of Portsmouth, Virginia:
<br />
<br /> That pending the passing of m general zoning ordinance for the City of Portsmouth, the
<br />erection or ~per~ion of any sto~e,~-P0oI~p~16r, movin~"pictu~e-theat~e,'Skating r~nk~ s0f:t'~ -
<br />drink estmblishment, public garage, industrial establishment or any other struCt~re~ excepting
<br />residences, apartment houses, churches or libraries in any block in which She majority of the
<br />buildings already erected a~e residences, apartment houses, churches or libraries is prohibited
<br />without the consent of the property owners immediately adjoining the site on which the proposed
<br />structure is to be erected or operated and without the further consent of the owners of three
<br />fourths of the frontage of the proper~y on each side of the street in the same block; provided,
<br />however, the restrictions herein named shall not ~oply to private garages erected on the rear
<br />half of mny lot or to any prohibited st-~uctures already erected or in operation or unde~ con-
<br />tract or in course of erection.
<br />
<br />All ordi~n.nees or parts of ordinances in conflict herewith are reD~aled.

<br />An emergency existing, this ordinance shall be in force on and after its passage."

<br /> ~. ~hite moved'that the privilege of the floor be granted to any o~e who m~ht desire to
<br />speake ms'to the ordinance. The motion was adopted, and Dr. J. C. Dunford and Nr. J. A. Mulvey
<br />spoke in favor of the passage of such an ordinance.

<br />Then N~. Oast moved that the ordin~nee be amended to read as follows,
<br />
<br />"AN ORDINANCE PROHIBITING THE ERECTION OF GARAGES IN RESIDENTIAL SECTIONS~
<br />
<br />Be it ordained by the Council of the City of Portsmouth,~Virginia:
<br />
<br /> That pending the passing of.a general zoning ordinance for the City of Portsmouth, the
<br />e~ection of any garage contmining one or more units~ln~any block in which the majority of the
<br />buildings, already e~ected are residences,~apa~tment houses, churches or libraries, is prohibited
<br />without the consent in writing of the property owners immediately adjoining the site on which
<br />the p~oposed etracture is to be mzected or operated and without the consent of the owners of
<br />three fourths of the property f~onti~g on each side of the street in the same block; provided,
<br />however, the restrictions herein contained shall not apply to garages erected on the rear half
<br />of any lot occupied by a building,or to structures already erected or .in the cc~rse of erection.
<br />A block for the purpose of this ordinance shall constitute the property ~ffronting on both sides
<br />of a street, between two intersecting streets.
<br />
<br /> Any person violatin~g~-~he provisions of this ordinance shall be fined not less than $25.00
<br />nor mo=ethan $100.00, and,mchday such structure is allowed to=emain standing shall constitute
<br />a separate offence.
<br />
