C. Smith, J. R. Stewart, R.E.B.. Stewart, <br /> L. G. White, <br /> Also the City Manager. <br /> <br /> The Council C~.mber being occupied, Council met in the Office of the Norfolk County Board <br />of Supervisors. <br /> <br /> Mr. Brooks moved that Council recess t.o meet in joint mestingwith the Norfolk County <br />Board of Supervisors. The motion was adopted~ <br /> <br /> Upon.re-convening, Mr. Brooks,o~fered the following resolutions, and moved that the same <br />be referred to the Finance Committee. The motion was adopted$ Mr. 0asr voting-No. <br /> <br /> "V~HEREAS, The Council of the City of Portsmouth in theLv Judgment believe that the con- <br />st~uction of the road between Deep Creek and the North Carolina State Line will promote the <br />material interest of the City, and that it is advisable that the City will use its funds for <br />the constraotion of said road; <br /> <br /> THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, T~t the City of <br />Portsmouth borrow a sum not to exceed Three Hnndmed and Ninety Thousaud ($390,000~00) Dollars <br />from the Banks of the City or from such other Bank, institution or person from whom the said <br />loan m~y be obtained, for the purpose of constructing the road mlong the Dismal Swamp Canal <br />from Deep Creek to the North 0arolina State line, and known as a portion of Route $~0, formerly <br />known as 1EX, of the State Hig~ay System, and that the proper 0ffioers of the City execute <br />the necessary'note or notes to borrow such sum of money ms may be. necessmry." <br /> <br /> "~HEREAS, The Council of the City of Portsmouth and the Board of Supervisors of the County <br />of'Nor~o~lk D~elieve it to be advantageous to this community to have constructed the road along <br />the Dismal Swamp ~anal, known as a portion of Route $~0 (formerly $12X) of the State Highway <br />System running from Deep Creek to the North Caroli~ State Line; and <br /> <br /> WHEREAS, the County of Norfolk will soon enter into a contract With the State Highway <br />Commission for the oonsmruction of this road and will advance the funds necessary therefor; <br /> <br /> E~REAS, the Council of the City of Portsmouth in their judgment believe that the con- <br />st~uction of said road will promote the ~aterial interest off the City of Portsmouth and believe <br />~ to the advantage of the City of Portsmouth to contribute funds to aid. in such construction; <br /> <br /> NOW, T~EEREFORE, BE IT RESOL.VE$ ~y the Council of the City of Portsmouth that it pay to <br />the County of Norfolk two-thirds (~/3) of the annual interest as the same mhall fall due, for <br />~he money borrowed for the construction of said road; <br /> <br /> BE IT FURTHER RESOLVED by the Council of the City of Portsmouth that in the even~ the <br />State of VLvginia should fail to refund to the County of Norfolk the money advanced for the <br />construction of the route aforesaid, then the City of Portsmouth shall indemnify ~nd save <br />harmless the County of Norfolk by reason of the sum or sums mdvanced under the contract afore- <br />said for the construction of the route aforesaid to the extent of the principal sum advanced, <br />with the exclusion of interest. <br /> <br /> And the Attomney for the City of Portsmouth in conjunction with the Attorney for the <br />Commonwealth ~r~orf~lk County is directed to draw a ~rit~en contract in duplicate embodying <br />~he terms of this resolution, and the proper officers of the said City s~re instructed to sign <br />and seal the same." <br /> <br />0~ motion, adjourned. <br /> <br /> <br />
