<br /> This Co~m~issisn h~ving given mature consideration to the petition of Virginia Railway
<br />and Power Company filed on the 4th day ef September, 192S, and praying for authority to dis-
<br />continue the operation of the electric street railway line known as the 'County Street Line,'
<br />in the City of Portsmouth, Virginia, and to the demurrer to the said petition filed on behalf
<br />of the said C ity~e~ Portsmouth ~on the 9th day of 0ctober¥ 192~, as well ms te the answer te
<br />the said petition filed by the $~id City ef Portsmouth on ~he date lastmentioned and to the
<br />evidence taken on the hearing of the~mid petition held in ~he courtroom ef this ~Commissien on
<br />~e said 9~ day of October, 1923, and it appearing to the Co--lesion that the said petition
<br />is ~fficient in law; and

<br /> It further appearing to the Commission from. the evidence that the said ,County Street
<br />Line,~ is eperated bythe Virginia Rail~may and Power Company as a part of the electric railway
<br />system kmown as the 'Portsmouth Railway Divisiom,' in the said City of Pe~tsmouth, and that
<br />the said ~County Street Line' is ~ single track line running parallel to the double track line
<br />of the smid company~ operated on HighStreet, a portion thereof being ~nX~ about five hundred
<br />(500) feet from T~hesaid High Street. and no portion thereof being further than two' (2) ~lecks
<br />mv~y from the said High Street; and that the petitioner is now charging a base Portsmouth per,
<br />mits the operation in competition with the said line of' jitney busses charging and collecting
<br />a rate not exceeding a five (5) cent b~se f~re; and

<br /> It~further appea~ing to the Co~ission that the operation of the said ~County-Street
<br />Line' is now ~vemuner~tive and that the service is maintained at'~ d~stinbt loss to the com-
<br />pany; ~aat for the twelve (12) months of the cmlmndar-year 1922 the operation shows total gross
<br />earnings ef $12,17~ and that the total operating expenses for that period were $2S,!05 and that
<br />for seven ~7) mon~hs of the year 192~ this operation resulted in a deficit ef
<br />
<br />IT IS 0~w. DERED, that the sa~d demurrer be, and the same is ~ereby, overruled; and
<br />
<br /> IT IS FURT~0RDEiLED, that the Virginia P~ilway and Power Company be, and it is
<br />hereby, authorized and granted permission on and after the _~ ~day of.December, 1923, to dis-
<br />continue the operation of the e~ectric street r~il~r~y ~ine known and described in these pro-
<br />ceed~mgs as the 'County Street Line' within the City of Portsmouth, Virgini~, that is-ts say~

<br />such tracks being so much of 'the street car tracks used in the 2~erat~on~of the 'County Street
<br />Li~e' ~s are not used by a~y ether car ~ute or line in ~ths City o~ Portsmouth; provided that
<br />inremoving smid t=acks, the Virginia Railway a'nd Powe~ Company sD~ll restore the ~treets,
<br />to be disturbed by said removal of the tracks, to the s~m~e condition in which the rest'of the
<br />street or highway is at the time of ss.id removal.
