5th, "With reference to the application of~s. Susan F. Rollins dated November 27th,
1923, for permission to erect a gasoline filling station at the corner of Court and Wythe
Sts,, I beg to state that the plans~for this structt~re have now been so chs. nged that it wilt
front on Court St., which is clearly a business street, The granting e£ the permit for the
erection of ~t~he building is thereEore entirely an executive matter ~whichmust be handled by
the Building Inspector with the approval of the City Manager.

The only question therefore before the Council is whether ~it is willing to open
up a portion of its~pro~erty at the northwest corner of Co~rt~andVtythe Sts. for use as a
driveway le~ding to the filling station Smd as a wmllomay in re~ of the st~tion~

It ~is to,be noted that t~.e applicant is granting ~ee use to the City of a consid-
erable portion of its l~voperty in ~ear~of the filling station for this walk way and the con~
structien of said walk w~y will remove the danger to pedestrians fro~ motor aa~s entering
er leaving the filling station.

I have taken up this question with Mr. Paul G. Blanford and he has stated thm~
he is net further interested in the matter as ~ehas closed a~deal for the erection of m
station on the opposite c~rner. ~

If the City Attorney in~ conjunction wzth the applzcant ca~ dr~w up a legal zn-
st~ment W3aich Will insure to the City the use of ~he sidewalk in .re~r ~f t~e filling station
du~ing the tLme the. building is used as a filling station and whi6h wili properly protect the
City's interests relative to the use of the.~riveway in front cf ~the S~ation which~passes im -
part over the Cit~ s proper~y at the' northwest corner ef Ce~t and ~ythe st~., it ms recommend
ed that the Council ~ppr~ve the ~se 6f~ the City's property for a driveway and v.~alkw~y."
Aley~nder with reference to sai~ matter:
"Portsmouth, V~., December 25, ~1925~

To the Honorable City Council, P$~tsmouth,

G~ntlemen:
In conversation with. General J. P. ~ervey, City~uager, afew days ago, with
refer~ace to a ~a~cel of land o~med by the Cmty~ sl~u~ted at the northwest corner of
and Court Streets, he suggested the I wrzte your Ho~or~able Boay sett'zng forth the pla~ as
outlined to him by me~

I suggested t~:~'~the~ fezmer City N~n~ger that if the City would permit me to use
the re~ning ground, after reserving sufficient ground for a proper sidewalk, I would permit
the City the use of t~he space in fron~ of my house No. 446 W~the Street, now enclosed, fora
sidewalk free of cost to the City. Ny purpose was to simply beautify the piece of property
referred to above. At present ther~e is no sidewalk in front of ~
prOpmerty on ~ythe Street,
~nd by some arrangement with the City, the public, ~s well as myself, would be taken care of
~ith reference to a sidewalk, As you well knew that it is an extremely d~gerous point, so
huch so that v~e~ applieati~en w~s ;m~de sometime ago for a gas station at that particular point
the ~cuncil look~d with disfavor e~ud -~equested the ~mmge. . o ask for the m~turn of ~e permit
tImt had already bee~ gran~ed.~ The s~.-me ~conditienm exist t~h~re te.de~v a. _~en the matter
before the ~ouncil last. Ey idea with reference to the ~ib lot owned by the City, ~djoining
my property, is not for ~he City to give :for deed to me and put any r~strmc~mons h.ha, they see
fit for the City's protectiqn, tjh~t is te~s~ that to prohibit buildLngs o£ any descriotien
or used for any commercial ~urposes. Ny sole ide~ zs to plant a hedge ~d ~lowers, The pro-
perty in front of my house, referred to above, can be used'by the City Without cost with the
understanding that should the City at any future time decide to sell ~ne property referred to
above, then the strip of _land fronti~ my house on Wythe Street would revert back to the

Per,it me to suggest to the Honorable Body with the lian~ger, that you vis, it
this point in a bqdy ~d see condm~mons of same.

I understand that an application is before the Council a~ preDent to establish
a gas s~atien and that a sidewalk ten Il0)feet wide ~un in a ~iagonal course ~rom m point
b~ginning on Cou~t Street through to Wy~he, having anou~let.adJo~ning my proRerty on Wythe
Street, In my ~ind that vould make it Wen mor~ dan~erous th~n ~the pr0~osal ef the first

Trusting that you ~ll give this~your c~reful consideration, end'visit this
point so that I ma~ be able to discuss the matter with you, I remain,

Very respectfully you~,
