<br /> 4th. "The a~ual convention of the N~tional Rivers and Harbors Congress will be held in
<br />Washington, December lOth and llth, 1924. As this convention is one in which ~ll seacoast
<br />cities a~e vitally inte~vested, I am of'thSmopinion that the Oity of Portsmouth should be pro-
<br />perly represented."

<br /> On motion of Mr. Stewart (J.R.), the recommendation of the Na~sger was concurred in,
<br />and by the following vote:
<br /> Ayes-- Hall, Stewart (J.R.), Stewart (R.E~B.), White,
<br /> Nays-- Brocks, Oast, Smith, 3-

<br /> The President ~amed the Oity ~nager and ~:R. Stewart to represent the 0ity at s~id Con-
<br />vention.

<br /> 5th. #D~rtng the past year a deficit which it is hoped will be temporary, of about
<br />$500.00, has been inc~rred in the League of Virginia Manicip~lities. At the Convention it
<br />was decide~ that an effort would be made to meet this deficit by asking au ~ppropriation of
<br />a~ additional $50,00 from each city whose annual dues were $50.00 or more.

<br /> ! recommend that a special appropriation of $50.00 he made for the purpose."

<br /> On motion, the recommendation was referred to the Finauoe Comm:ittee.

<br /> 6th. "X am forwarding herewith_letter from the City Attorney dated November 12th, i~
<br />which he states that he has been umable to get any recommendation from Government officials
<br />relative-to compromise offer authorized by the Council in settlement of the suit now pending
<br />in the District Oourt of the'United States brought by the Unites States against the Oity, to
<br />recover the interest due on the water contract.
<br />
<br /> There seems to be some ch~a~c~ of having the claim adjusted along with the appraisal
<br />of property, provided the Oi~ypa~s Snto Oourt or ~o ~eUnited States the amgu~t of interest
<br />~dmitted to be due which is $58,362.18. To this mastiCS dded 0ou~t costs of $16.80, making
<br />a total of $58,37~.98. The approval of this action at this meeting of the Oouncil is request-
<br />ed as the case comes up for tri~l o$ December 2nd."

<br />for the Eastern DistriCt of Virginia brought by the United Stmtes s~al~st the 0ity to recover
<br />the interest.due on the w~ter contract.

<br /> I have had~o success whatever with this matter, and I have been unable to get
<br />auy-recommendation from the Government officials ~ding to a settlement. O~m only hope in -
<br />getting an-adjustment of the m~tter is to have the disputed pa~t cf the interest claim adjust
<br />ed along with the app~i~ememt of the property. There seems to be some hope of havlmg this '
<br />done but in o~der ~o dose it willbe necessary f~r th~ Oi~y to pay the amount of the interest
<br />~hich the Oity admits is owing. This amoumts to $58,362.18, and it will have to either be
<br />paid into Court or~to the United States Government in. such masquer as the District Attorney
<br />shall direct.

<br /> X, therefore, request~that the p~o~er~cIty officials be authorized to pay the
<br />above amount toge~er with'the Oourt costs of $1~.~0, which is the amount of interest the city
<br />admits owing. ~pon the payment of this ~mount we expect to have the case conti~edaud the
<br />settlement of the remaining interest claimed by the government taken up along with the appease-
<br />ment bf the property.

<br /> The case is set for trial on December 2nd, amd as this is n6t a new matter but
<br />on~ whiqh has been pendi~g~before the.council for considerable time, I hope you will authorize
<br />the payment Of the above amount at this meeting of the
