<br />Leckie and Villa Streets and designated as Lot l?-on the new plat and survey of the Park
<br />View Terrace Company, recorded ~n N.B. 1, Page 9, Clerk's Office of the 0curt of Hustings
<br />far the City of Portsmouth, Virginia, the said lot front~ing on Armstrong Street 2y feet mud
<br />having ak.depth of one hundmed and five feet.

<br /> And it further appearing to the 0curt, as aforesaid, that there are delinquent Stat'e-
<br />taxes charged in the Office of the Olerk of the Court of HUstings for the ~ity of Portsmouth,
<br />Virginia, for the Yea~s from 1904 to 1920, against said two parcels of land.

<br /> And ~t appearing to the Court from the records and evidence as aforesaid, that from~he
<br />years 1~O~ to 1~O?, the said Annie T. Earretl was life ~enant of said property, and that
<br />from the years 190~ to 1920, inclusive, said James A. Harrell was tenant of said property
<br />for the lifo'of said Annie T. Harrell, and that .said Annie T. Harretl died in Nay, 1921:

<br /> The OOUrt i~ of the opinion and doSh so state, that there was no merger of the remainder
<br />of said James ~. Narrell with the life estate granted to him bY deed of said Annie T. Harrell
<br />by deed dated November 13, 190?, and 'recorded in the Clerk's Office of this Court ih D.B.
<br />5?, P~ ~5, and t.hat none of the taxes, either 0ity or State, charged against said property
<br />for the years 190~ to '1920, i~clusive, constitwate a lien on said real estate, and the s~id
<br />F. O. Hsmrahan, Oity Oollector, is hereby directed to mark off said city taxes from the books
<br />in his office.

<br /> Nothing contained in this order,, however, shall in any way affect the right of the 0ity
<br />of Portsmouth, or the State of Virginia, to proceed through its proper offioers, sgainst the
<br />said James A. Ha~rell for his personal liability for such taxes ~s accrued while he was
<br />tenant of said property for the life of said A~mie T. Harrell.
