<br />the U. S. Government and the City of Portsmouth in settlement of the amount due the Government
<br />by the City for extensicras to the waterworks system:

<br />as the CITY), acting through its City Council, pa~ty of the second part.

<br /> 1. WI/EREAS, by~:contr.act da%ed October i5, 1918, made by R. C.. ~arshall, Brigadier General,
<br />U.S.A., for and in behalf of the United States of America with the City 9f Portsmouth, Virginia,
<br />the United States a~reed.~o~-farhish and install certain additions to the water works system
<br />of the CXTY, the title to said additions to remai~ in the United States until the same shall
<br />have Been purchased in the manner provided; and
<br />
<br />WHEREAS, th~ additions contemplated at the time of said contract were to include:

<br />Xnstallation of ~eters.
<br />
<br />Raising the dam at Lake Oahoon, together with necessary lands.
<br />
<br />Additional Pumping Ecfaipment at Lake Cahoon Pumping Station.
<br />
<br />Additional Pipe between Lake Cahoom and Lake KilbyPumping Station.
<br />
<br />E~largement of Filtration Plant at Lake Kilby.
<br />
<br />Additional Famping Equipment at Lake KilBy Pumping Station.
<br />
<br />Additiomal Supply Main from Lake Kilby Pumping Station to Portsmouth Pump-
<br /> Station.
<br />
<br />Additional Reservoir and Pumping Equipment at Portsmouth Pumping
<br />Station.
<br />
<br />A 2~# main from Portsmouth Pumping Station to the vicinity of
<br />the Navy Yard with connection to the Navy Yard distribution
<br /> system.

<br />A 20" main across the rivers and Berkley to connect ~he
<br />Norfolk Distribution System.
<br />
<br />The 20" main across the rivers i~rom Berkley was never laid;

<br /> 3. WF~REAS, the United States upon the completion Of the installation of the increased
<br />facilities turned over tO the CITY, for its use, property for which the CITY gave a receipt
<br />dated April 19~ 1920, photostat copy of which is made a part of this agreement, ,~eked
<br />"Schedule A;" and
<br />
<br /> ~. WHEREAS, Article ~ of the c~ntraot of October 15, 1918, provides that the ~TY
<br />sha~l pay s~mi-aunually.%o the Government interest at the rate of5% per annum on the cost
<br />of said additions, as said cost shall he'paid by the ~vernment, provided that the amoumt
<br />of said interest shall ~o~_exceedatany time one-half of the increase in gross revenue
<br />above the th~ugross reven~e and provided that should said interest at 5%exceed one-half
<br />of the in~rease in gross revenue then th~ amount to be paid to the Government by the CITY
<br />shall be limited to one-half of the ~ncrease of the gross revenue and it was mutually agreed
<br />for the purpose of the contract that the.gross revenue from said water works system should
<br />be taken to be at the rate of $32~,000.00 per annum; and

<br /> 5- WHEREAS, a controvers~'has arisen relative to this article of the contract'and is
