June 26, 2001 <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Willie Torain and his successor(s) in interest are hereby granted a use <br />permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia <br />(1988) for the operation of a residential care facility on property located at 831-833 <br />Potomac Avenue, and being more particularly described as: <br /> <br />UP-01-11 <br /> <br />Beginning at the southeast corner of Potomac Avenue and Clowe <br />Street; thence, in a easterly direction 100 '+ to a point; thence, in a <br />southerly direction 75'+ to a point; thence in an westerly direction <br />100'+ to a point; thence, in a northerly direction 75'+ to a point of <br />the beginning. <br /> <br /> 3. That the use permit is approved subject to the following conditions which <br />shall apply to the applicant and any successor in interest: <br /> <br />(a) Occupancy shall not exceed six adult residents at any time. <br /> <br /> (b) Development shall be in accordance with the approved site plan and floor <br />plan, identified as Exhibits A and B, and made a part hereof. <br /> <br /> (c) The facility shall provide and maintain three off-street parking spaces <br />meeting applicable codes. <br /> <br /> (d) A furnished area for outdoor recreation shall be provided and maintained <br />at the rear of the property. <br /> <br />(e) A 10% tree canopy for the lot shall be provided and maintained. <br /> <br /> (f) The applicant shall submit a plan for the handling, storage and removal of <br />trash for the site. The plan must be approved by the City Department of General <br />Services prior to commencement of operation of the facility. <br /> <br /> (g) The applicant and any successor in interest shall comply with all <br />applicable codes, ordinances, and regulations of federal, state and local governments <br />and shall obtain and maintain in effect all necessary licenses and permits. <br /> <br /> (h) All taxes and fees in connection with the subject property and operation <br />shall be paid when due. <br /> <br /> 4.
