<br /> I am informed that ~our Honorable Body is being requested to sell the jail lot
<br />as a site for a hotel for the City 6f Portsmouth, amd that if the site is sold, 10 feet at
<br />the rear is to be reserved asa light-and air space for the Briggs School Building.
<br />
<br /> While I do not Wi~h to be thought of as being opposed to a new hotel for the
<br />0ity of Portsmouth, as I'oonsider an up-to-date hotel one of the great needs of our city,
<br />nor do ! wish to be considered as being'opp0sed to the ~rection of a hotel en this site, yet
<br />I wish tO express the opinion that the l0 ~cot space is not sufficient for a b~ildtng of the
<br />height proposed. It should be at least 20 feet.

<br /> Iam sure that before your final decision im this matter is made, you will give
<br />this your careful consideration.

<br /> This day came the petitioner, Beneficial Loan Society, Inc., ~ coummel, and p~.aying leave
<br />to file its petition praying relief from~ertain taxes on capital, assessed against it by the
<br />Oommonwealth of Virginia, and the City of Portsmouth, Virginia, and setting.out that the said
<br />amount'now~ssessed against it as taxable capital for the year 19~5,~me~ntzug to eighty-five
<br />thousand f~'hundred and forty, eight dollsms ($~5,~.00), w~s ev~__gneous~ and that said taxable
<br />cspital should be assessed as fifty thousand, three huncLred eighty mwo an~ 15/100 dollars
<br />($50,3S2.15), and was argued by counsel.
<br />
<br /> And it appearing to the court that the said applicant is erroneously assessed with taxes
<br />on capital, and that said erroneous assessment was not caused by the failure or refusal of
<br />the a~licant ~o fur~ish a list of its property, ~oth real amd personal, to ~he Oommissione~
<br />cf Revenue, on oath as the law requires; and further this petition being defended by the
<br />Attorney for the Oommonwealth cf the City cf Portsmouth and the Olty Attorney for the City of
<br />Portsmouth, a~d the Commissioner of Revenue for the City of Portsmouth, the Oommissioner making
<br />the assessment being examined as a witness tou~hL~g the application; and further, the said
<br />erroneous assessment being caused by a mistake.
<br />
<br /> It is a~judged, ordered and decreed that the said assessment against the Beneficial Loam
<br />Society, Inc.~ be corrected and cha~ed so that the amount of said assessment shall be fifty
<br />thousand three hundred eighty-two and 15/100 dollars ($50,382.15), and the amount of the tax
<br />due to the Oity of Portsmouth shall be one hundred fifty-one and 15/100 dollars ($15~.i5), ~-~d
<br />that due the State of Virginia, shall be fou~ h~mdred twenty~_eight and 25/lO0~dollars
<br />exclusive of the lawfu~l penalty on the said a~cunts; and that said Oity Treasurer,and Oily
<br />Oollect are hereby~irected to correct the~said assessment so that the same m~.v
