June 27, 199~ <br /> <br />95-314 Letter from the City Manager recommending adoption of <br />a motion to repeal the application of the vesting requirement <br />of Section 30-236 (c) of the City Code. <br /> <br /> "On April 25, 1995, Mr. Edward White the Chairman of the <br />Portsmouth Supplemental and Fire and Police Retirement Board <br />asked that I request City Council to repeal the Retirement Code <br />in order to allow a former member to receive a pension. <br /> <br /> In 1972 an employee of the Police Department terminated <br />employment at the age of 49 years and 6 months and after the <br />completion of 24 years of service. At the time of this <br />termination he was informed that he was vested and would be <br />eligible to receive a pension at age 60. However, he later <br />learned that in order to receive a pension at the time of his <br />termination, a member had to be age 50 with at least 20 years <br />of service. <br /> <br /> The Retirement Board, after reviewing the individual's <br />statement, unanimously agreed that he had received erroneous <br />information and he should be entitled to a pension. <br /> <br /> In order for the Retirement Board to review hie <br />application for normal service retirement City Council must <br />consider repealing Section 30-236 (c) i of the Retirement <br />Code." <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Martin, to <br />waive the application of Section 30-236 (c) i of the Retirement <br />Code as to Charles Ragland only, and was adopted by the <br />following vote: <br /> <br />Ayes: Clemons, Griffin, Hawks, Pitts, Robinett <br />Nays: None <br />Abstained: Martin represents applicant. <br /> <br />- NEW BUSINESS - <br /> <br />95-316 Boards and Commission <br /> <br />There were no appointments. <br /> <br />95-317 Items Submitted by Council Members <br /> <br />Councilman Martin requested further information on a letter <br />received that referenced drug dealing in the Cavalier Manor <br />area. <br /> <br />Councilman Martin requested expedient Scheduling of public <br />hearings for elected School BoardS. <br /> <br />95-318 - Receipt of Other Communications <br /> <br />There were no other communications. <br /> <br />95-319 - Continued Non-Agenda Speakers <br /> <br />There were no other speakers. <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Hawks, to go into <br />ExeCutive Session pursuant to provisions of Section 2.1-344 of <br />the Code of Virginia for the following: <br /> <br /> (1) Consideration of a personnel matter involving Council <br />appointees, as permitted under Subsection (A) (1). <br /> <br /> The motion was adopted by unanimous vote. <br /> <br /> Motion of Mr. Martin, and seconded by Mr. Pitts, pursuant <br />to Section 2.1-344.1 of the Code of Virginia certifying that to <br />the best of the Council member's knowledge during the <br />immediately preceding Executive Session of the City Council: <br /> <br /> <br />
