The following communication was read from the Ns~r as to the ordinance:

Honorable 0ity Council, "July 27, 1926.
~Por tsmouth, Va.

Gentlemen:

Mr. J. T. Bannister and others request that saw mills and wood working establishments
be added to the list of industries for which sites must be approved by the 0ounctl before erection.
It is recommended that this request be approved.

Er. Bann/ster also calls attention to the fact t~t by m~king the limits apply to
the block in which the prohibited structure is situated rather than to the area withl~'~ certain
distance of this structume does not give protection to owners in rear of structures in question.

It may be well therefore to substitute a limited area of 200 ft. in radius for the
block as defined. In this case, the para,nh following the list of structttres would read as
follows:
' ~here such structures ame proposed to be erected or altered.and the majority of
the buildings already erected within a radius of 200 ft. of said structures are
residences, apartment houses, churches or libraries or if such area is a strictly
resideatial sect~o~ thcug~ not occu~ied by but±dinEs, the applicant will secure
~he b6~sent of the propermy owners ~mmediately adjoining the site on which the
proposed struc$~re is to be erected, altered or operated and the -~%t~ther consent
of the owners of two-thirds of the_ lots within a radius of 200 ft. of the proposed
structure; provided, however, the restrictions herein name~shall not apply to
private garages erected on the rear half of any lot so long as~ the ge~r~ge or gar-
ages so erected do not front directly within six ft. of the street or within five
ft. of any dwelling on an adjoining lotwithout the consent of the owner of sa/d
~e~l~.n~.~ if the ~rop~r~y in qu~stiop %s a corner lot. Garages erected in connec-
tion wl~n aa apar~menm house an~ renmed generally to occupaats o~ said apartment
shall be classed as private garages. Provided, further, this orainance ~hall not
apply to any prohibited structures already erected or in operation, or under con-
tract or in course of erection.,

The next paragraph of the ordinance definLng a block could be omitted.

Yours truly,
