<br /> On yesterday a verdict was rendered against the City for $20001 by a jury in the
<br /> Circuit Cottrt of the City of Portsmouth in the sui~ of Lydia A. Zink against the City of Ports-
<br /> mouth for an injury received by Mrs. Zink mt~the City m~rket cn Saturday night, December 1~,
<br /> i9~. MrS. ~ink fell over a rise in the sidewalk on Oolumbia Street and broke her arm. A motion
<br /> for a new trial was made on behalf of the city and argument on the motion was set for April 25,
<br /> 192?. -Mrs. Zink~s signified her willingness to compromise the case for $999.00 provmded
<br /> settlement is made at once.
<br />
<br /> While I never believed the rise in the sidewalk ever which Mrs. Zink claims to have
<br /> stumbled~was smff~¢ientto establish negligence on the part of the City, yet the jury decided
<br /> this q~eStio~ agamnst the 0ity under an instruction fro~ the oomrt placing the question eq,~areiy
<br /> up to.them. This jury was composed o~ seven men, some of whom are property owners and in view
<br /> of this verdict! recommend that the ccmpromis~ be made. It will b~ necessary for the 0ity to
<br />i p~ythe Co'~.vt costs.~
