March 26, 2002 (a) The applicant shall develop the site in accordance with a plan approved by the Planning Director. (b) The applicant and any successor in interest shall comply with all applicable statutes, ordinances and regulations of federal, state and local governments and shall obtain and maintain in effect all required permits. (c) All exterior modifications shall be approved by the Downtown Design Committee. (d) The applicant shall provide six off-street parking spaces. (e) Prior to occupancy, the Director of General Services must have approved the applicant's proposed refuse storage and removal plan. (f) when due. All taxes owed on or in connection with the subject property shall be paid 3. EXPIRATION OF PERMIT: Unless extended as provided under Section 40- 115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use permit shall expire for any portion of the approved project for which building permits have not been issued if the applicant fails to apply for all building permits for the entire project within one year of the adoption of this resolution. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the permit by the City Council." 02-72(g): "ZONING AMENDMENT ORDINANCE Z-02-03." 02-72(f): "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT (GHP-01-02) TO PERMIT EBENEZER BAPTIST CHURCH AND NEW MOUNT OLIVET BAPTIST CHURCH TO CONSTRUCT AND OPERATE 112 APARTMENTS FOR THE ELDERLY IN THE 900 BLOCK OF COUNTY STREET. WHEREAS, Ebenezer Baptist Church and New Mount Olivet Baptist Church have made application pursuant to Section 40-112 of the Code of the City of Portsmouth, Virginia (1988), as amended, for the approval and granting of a group housing permit for 112 apartments for the elderly in the 900 block of County Street, Portsmouth, Virginia, more particularly described as follows: GHP-02-02 Beginning at the southeast corner of Apple and County Streets; thence, in an easterly direction 88'+ to a point; thence, in a northerly direction 112'+ to a point; thence, in an easterly 50'+ to a point; thence, in a southerly direction 112'+ to a point; thence, in an easterly direction 272'+ to a point; thence, in a northerly direction 225'+ to a point; thence, in a westerly direction 410'+ to a point; thence, in a southerly direction 225'+ to a point of the beginning. and WHEREAS, the Planning Commission has reviewed such application and site plan submitted therewith and has recommended conditional approval of said application; and WHEREAS, the applicants have been informed that approval of the group housing project pursuant to Section 40-116 only grants an exemption from certain requirements for residences as stated in said section and does not constitute a waiver of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal law or regulation; and
