March 26, 2002 <br /> <br /> (a) The applicant shall develop the site in accordance with a plan approved by <br />the Planning Director. <br /> <br /> (b) The applicant and any successor in interest shall comply with all <br />applicable statutes, ordinances and regulations of federal, state and local governments <br />and shall obtain and maintain in effect all required permits. <br /> <br /> (c) All exterior modifications shall be approved by the Downtown Design <br />Committee. <br /> <br />(d) The applicant shall provide six off-street parking spaces. <br /> <br /> (e) Prior to occupancy, the Director of General Services must have approved <br />the applicant's proposed refuse storage and removal plan. <br /> <br /> (f) <br />when due. <br /> <br />All taxes owed on or in connection with the subject property shall be paid <br /> <br /> 3. EXPIRATION OF PERMIT: Unless extended as provided under Section 40- <br />115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use permit <br />shall expire for any portion of the approved project for which building permits have not <br />been issued if the applicant fails to apply for all building permits for the entire project <br />within one year of the adoption of this resolution. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />02-72(g): <br /> <br />"ZONING AMENDMENT ORDINANCE Z-02-03." <br /> <br />02-72(f): <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-01-02) TO PERMIT EBENEZER BAPTIST CHURCH AND NEW MOUNT <br />OLIVET BAPTIST CHURCH TO CONSTRUCT AND OPERATE 112 APARTMENTS <br />FOR THE ELDERLY IN THE 900 BLOCK OF COUNTY STREET. <br /> <br /> WHEREAS, Ebenezer Baptist Church and New Mount Olivet Baptist Church <br />have made application pursuant to Section 40-112 of the Code of the City of <br />Portsmouth, Virginia (1988), as amended, for the approval and granting of a group <br />housing permit for 112 apartments for the elderly in the 900 block of County Street, <br />Portsmouth, Virginia, more particularly described as follows: <br /> <br />GHP-02-02 <br /> <br />Beginning at the southeast corner of Apple and County <br />Streets; thence, in an easterly direction 88'+ to a point; <br />thence, in a northerly direction 112'+ to a point; thence, in an <br />easterly 50'+ to a point; thence, in a southerly direction 112'+ <br />to a point; thence, in an easterly direction 272'+ to a point; <br />thence, in a northerly direction 225'+ to a point; thence, in a <br />westerly direction 410'+ to a point; thence, in a southerly <br />direction 225'+ to a point of the beginning. <br /> <br />and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended conditional approval of said <br />application; and <br /> <br /> WHEREAS, the applicants have been informed that approval of the group <br />housing project pursuant to Section 40-116 only grants an exemption from certain <br />requirements for residences as stated in said section and does not constitute a waiver <br />of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, <br />Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal <br />law or regulation; and <br /> <br /> <br />
