January <br /> <br />Oity of Norfolk, amd ~he Oonnty of Norfolk a~e hereby jointly authorized and empowered to <br />construct suitable and substantial bridge or bridges, tunnel oz tunnels, or both, over and <br />across the Elizabeth Eiver,~or its branches, from~ the City of Portsmouth to the City oft Nor- <br />folk, ~ud the said 0ities of Portsmouth and Norfolk, and 0~unty of Norfolk are hereby further <br />authorized and empowered to enter into contracts (not in conflict with the 0onstitution of <br />Virginia) for the construction of the aforesaid bridge, bridges~ tunnel or tunnels, and to <br />and with each other concerning the construction, r~inten~uce~ and eoeration thereof. The <br />said bridge or bridges, tunnel or tunnels_shall be constructed in a~cordance with the re- <br />quirements of the ~a~ Department of the United States of America. <br /> <br /> ~ " Oity of Norfolk in accordance with Clause B of Sec- <br /> 2. The City of Portsmouth and the <br />tion one hundred and twenty-seven of the Oon'stitution of Virginia, and the Oounty ~f Norfolk <br />a~e::hereby authorized to borrow money and to issue their Several registered or coupon bonds <br />for such smount as may be necessary to pay the costs of constructing said bridge, bridges, <br />tunnel or tunnels, in whole or in part; provided the same shall not exceed in the aggregate <br />the sum of $10,OOO,O00.00o The Oity of Norfolk may issue additional bonds for the purpose of <br />compensating the City of Portsmouth and the County of Norfolk, or either of them, for their <br />i~terest in the Norfolk Ooumty Ferries. The said bonds may be sold at one time or from time <br />to time as the money may be needed, and shall be in such denominations and bear such zat~ <br />of interest as the respective councils of the cities and the Board of Supervisors of the <br />County may determine, provided said interest shell not exceed six per cent per ~nnu~m, and <br />said bonds shall not be sold for less than their par value, and shall be payable not exceeding <br />thirty years from the date of their issuance. The maid bonds shall be subject to no taxation <br />whatever by the City of Portsmouth~ the City of.Norfol~, the 0ounty of Norfolk, or the State <br />of Virginia. A sufficient amoun~ of the revenue ~f sazd o_mdge, bridges, tunnel or tunnels <br />shall be set apart by said cities and county to pay the interest on said bonds and an annual <br />amount shall be covered into a sinking fund sufficient to. pay said bonds at maturity. <br /> <br /> 3- ~hen the bridge or bridges, tunnel or tunnels, or both, shall have been constructed <br />~ud opened for use by the public, the cities of Portsmouth mud No-~folk, and the 0ounty of <br />Norfolk shall have authority to make such ordinances, ~ules, and regulations as ~hey may deem <br />best for the operation and maintenance or. said bridge, bridges, tunnel or tu~_uels, and shall <br />have authority to ~stablish. a reasonable system of tolls for the use thereof by the public; <br />and the Oity of Norfolk may provide and agree with s~id Oity of Portsmouth s~ud County of <br />Norfolk that out of the one-third of the receipts from said bridge, bridges, tunnel or tumnels <br />belonging to it, s~fter setting apart a sufficient amount to pay the interest and sinking fund <br />on the bonds which it issues hereunder, shall be oaid to the City of Portsmouth ~ud the County <br />of Norfolk, or eit~her of them, for their interest-in om loss occasioned by said bridge, bridges, <br />tunnel or tunnels, to the Norfolk 0ounty Ferries. <br /> <br /> The Oouncils of the said 0ities of Portsmouth and Norfolk and the Board of Supervisors <br />of the Oounty of Norfolk shall provide suitable penalties for the violatiom of ordinances, <br />~ales, and regulations made for the government and operation of said bridge, bridges, tunnel <br />or tunnels, and the Oivil and Police Jusiioe of the 0ity of Portsmouth and the Police Justice <br />of the Oity of Norfolk shall have concurrent jurisdiction to enforce the penalties provided <br />for the violation of said ordinances, rules, or regulations, ~ud to try offenses committed <br />on said bridge, bridges, tu~el or tunnels°" <br /> <br /> RLr.
