<br />which they have handled the Sinking Fund.

<br />mamked off the land books.

<br />held on the '28th day of February, 1928:

<br /> This day came L. T. Caplan a~ud filed his petition alleging that there is assessed in his
<br />name on the land books of the City of Portsmouth and th? State of Virginia I lot of land 160
<br />S. High Street for ~he years 192~ ~land book page 271 t~ne 13), 1922 (land book'page 2?2 line
<br />18), and t925 ('land book page ~ ~e 17), and that he is not, nor has he ever been, the owner
<br />9f sa~d lot of land, and that 0ity taxes are delinquent ~hereon for the year 1921 amounting to
<br />$11.1~, for ~he year 1922 amounting to $10.69 and for the year 1~25 amount%rig to $13.?6, a~d
<br />that State taxes are ~elinquent' thereon for the year 1925 amount~n~ to $1.69 together with
<br />interest, penalty and clerk's fee for releasing said tax; and thereupon he moved the Court
<br />to expmgned the land books and records of the said assessment and to cancel the taxex charged
<br />to him theremnder, which said motion was defended by R. B. Albertson~ Commonwealth Attorney
<br />for the City of Portsmouth, and R. C. Barclay, City Attorney for the City of Portsmouth, and
<br />the Commissioner of the Revenue of the 0ity of Portsmouth was examined as a witness touching
<br />said petition.
<br />
<br /> Upon consideration whereof, it appearing to the court that the said L. T. Caplan is not
<br />the owner, nor has he ever been the owner, of lot 160 S. High Street, Portsmouth, Virginia,
<br />and that the assessment in his name for the years 1921, 1922, and 1925 is null and void and
<br />illegal, it is ordered that the land books of the City of Portsmouth and the State of Virginia
<br />be and they mare hereby expugned of said assessment and all taxes, both city and state, charged
<br />to the said L. T. Caplanupon said assessment for the years 1921, 1922~ and 1925 are hereby
<br />cancelled.
