regular meeting August 2Sth and special meeting September let were

J. R. Soule,

2nd. "The communicatio~from Miss Virginia Cooke ,tatxng that p~operty owned by her,
jaceat to the inoineratorsi~e, had been. encroached upon by the City, has been referred to me.
Miss' Cooke has taken this ms. fret up With moon several occasions e~ I have in t~Urn'~ef~=~ed
it to the CityAttorney. On August 3r~i, I had a letter from the. City Attorney regarding this
question and attached you will find aopy of a letter which I wrote Miss Cooke on August
prior to her writing the Council.

It appears to.me thatifMiss Cooke has any claim she should ests~blish the claim.
She should have her property surveyed and let us know to what extent the incinerator site
encroaches on her property. The Ci%~y Attorney states that he could not find any deed for the
property to Miss Cooke and from the best information he could gather Miss Cooke had no-deed.:
So, it appea~s to me if that is the case, we could not pay Miss 0coke any money unless we
could receive, proper legal transfer for the property, should it be determined there is au
encroachment.

On motion of Mr. White, the report was reoeivedland ordered to be filed.

3rd~ #With reference to the communication from Mr. H. L. Alexander as to what disposition
had beenmade of his offer to sell the city property adjoining the Wythe St. playground, wxll-
state tha$ I have gone over this matter very thoroughly, and have always felt that the frontage
there was desirable and so stated to the Council in a letter dated April 10th, but did not
make a definite recommendation.

I have talked the matter over with Dr. Roper, who has cha~ge of parks and play-
grounds and he states that he also was at one time in favor of acquiring ~his land, but since
a very lazge ~o~ion at the southeast corner has been aold and-is now occupied by a g~s
station and garages, the acquisition of the property now offered would only furnish a Court
St. entrance to~the playground and that he does not believe it would be advantageous to the
City to purchase the property for that purpose.

In ~i~w of the fact that we have so many needed improvements at this time, I feel
that the City would not be in a position to accept Mr. Alexander's offer."

On motion of Dr. Dunford, the recommendation of the Manager was concurred in.

Sth. #I respectfully ask permission to be absent from the City during the week beginning
Monday, September l?th.#
On motion:.of~Dr. Dumford, the request~of the Manager was granted.
