UNFINISHED BUSINESS
The following communication from the City Attorney, which had been laid on the Sable until
this meeting, was taken up and rea~:

~entlemen:

In reference to two co~mmunications from the City Collector referred to me at
last meeting, I find the following.:~ There was assessed to Joseph A. Guthrie for 1925, 14y°ur
lots
~u~bers 8 to 21~to¢k 2, West End Park View, and for 1926, 192y, 1928 13 lots numbers 8 to 20
n block 2. Norman Cassell, Trustee, paid onlots 15, 16, ly, 18, and 19. Harry A. Brinkley,
Trustee, later sold under ad, ed thlrte.en~loSsunder a deed cf~ trUsS So L. C~ D~ghty, but w~ich
sale did not include let ~0. Mr. Brlnkley then paid taxes for 1925, 1926, and I~2~ on lots
8, 9, ~O~ 11, 12, 13, 14'and 20 in block 2 and Mr. Doughty paid taxes for 1928 on the same
property. It w~s not their intention to pay on lot 20, and I understand from the City Oollector
~ ~r~l~ ~m~e~s~ ~l~f ~istake. For this re,son the Oity Collector is askin~ that
_' . ~ ~ . ~ $' 1925, $Y.50 for 1926,'and $8~10 for 1927; and that Mr. .
ooughty ce refunaed $?~95 for 192~. The shove smounts are correct and I c~u see no reason why
the refunds should mot be made. The Ciiy Collector states that she would call in the receipts
and place the charge back on her books fo~ los 20 which is still' owned by Joseph A. Guthrie.

Yours~ very truly,

R. C. Barclay, City Attorney.,
On motion of Mr. Oast, the refunds were not allowed.

Honorable City Oouncil,
Portsmouth, Va.

Dear

At your last meeting you referred to me a communication from the City Collector
requesting refund of $2.yO to E. B. Shea, and $34~45 to T. S. Collins.

- Mr. Shea asked~to,pay the real estate taxes assessed against Mrs. Nora J. Cox, and
by mistake the personal tax of ~rs. Cox was included s~d Mr~ Shea paid the same not knowing
it at the time. He later requested the City Collector to correct She er=or but the money'had
been paid into the city treasury.

Im November, t9P2~, T. S. Collins paid his taxes on a number~of pieces of property
and by mistake he paid on 15~9-1511 Glasgow Street amounting ~'$3~.45. He had previously sold
the property. In a few days time he discovered the mistake and returned the receipt to the
City ~olle¢tor and requested a refund. The receipt has been pinned back in the book and a
proper charge made against the property. Collins requested the owner of the property to pay
him the taxes and the matter has been pending for this reason, b~t the owner seems unable to
pay the same a~ this time.

in my opinion the money should be refunded in both cases.

Yours very truly,

R. O. Barclay, City AStorney~·

On motion of Dr. Dunford, the recommendation of~the City Attorney was
special appropriationsof $2.y0 and $3~.45 were allowed to make the refund.
