March 12, 1929 <br /> <br />At a regular meeting of the City Council held March 12th <br /> <br /> Messrs-- Vernon Brooks, J. C, Dunford, <br /> Arthur Mayo, J. Alden 0asr, <br /> Archibald Ogg, <br /> Also the City Manager. <br /> <br /> at 8 p.m.-there were present: <br /> <br />E.W. Maupin, <br /> R. Stewart, <br /> <br /> The minutes of the regular meeting February 26th and joint meeting with the Board of <br /> Supervisors of Norfolk ~ounty March 12th at 11 a. m. were read and were approved. <br /> <br /> The following communications were read from the 0ity Manager: <br /> <br /> let. "This is to notify <br /> you of the death on February 24th, 1929, of L.0. Calvert, retired police officer., <br /> On motion, the communication was~Ordered to be filed. <br /> <br /> ~2nd. "On June 18th, 1923, a lot in Olive Branch Oemetery was sold to W. L. Matthews and <br />S. E. Brinkley ~nd a certificate was issued for the lot. For some reason or other the man in <br />charge at that time failed to record the sale of that lot on the books at the cemetery and <br />later on the same lot was sold to a Er. Bateman who buried his child there. The mistake was <br />discovered; Dr.~ Roper and Mr. Dashiells had severs~ conferences with the parties. The matter <br />was later h~udled by 0ity Ms~uager Jervey. On advice of Mr. Barclay, the city offeredNessrs. <br />Matthews and Brinkley any lot~in the cemetery in place of the one purchased or their money <br />back with interest. Dr. Roper also offered to remove the remains from the BatsmAn lot at the <br />expense of'the city and to give Mr. Batsman any other lot in the cemetery. None of the parties <br />would accept the offers made. <br /> <br /> Since that time, they have made several efforts· at adjustment and talked with at- <br /> torneys on the question and recently a Er. E. B. Parker, of Pender, Way & Foreman, has talked <br /> the matter over with Mr. Barclay and asked if the city would offe~ to refund the price of the <br /> lot with interest. We have a letter containing that offer. Mr. Barclay recommends that the <br /> city refund to Messrs. Matthews and Brinkley the sum of $2i4.80 co~ering .initial cost of the <br /> lot together with interest from June 18th, 1923. I approve his recommendation and ask that <br /> you m~ke appropriations covering same., ~ <br /> <br /> Br. Dunford moved that the recommendation of the 'Manager be concurred in, and that an <br /> appropriation of $21~.80 be allowed from Oemetery Fund~for said payment. % <br /> The motion was adopted, and by the following vote: <br /> <br /> Ayes-- Brooks, Dunford, Eaupin, Mayo, Cast, Stewart, Ogg, ?. <br /> <br /> 3rd. "There are two very important items which I would like to bring to your attention. <br /> <br /> I would like to ask permission to h~ve an estimate made for doing away with the <br /> parkway on Washington St. from County to High. This zs made almost necessary at this time <br /> as the building now under construction at High and Washington Sts, will be occupied largely <br /> by medical, men who will need parking space for~eme~gency cars, etc. and for the convenience <br /> of our citizens. I am of the opinion that there will be much congestion at this place with <br /> the narrow roadways on these two blocks and that it would be advisable to ma~e some plan to <br /> take care of th~ situation at 'an early date and looking to that end, I am~asking for permission <br /> to go into thematter ~horoughly and present an estimate with definite recommendation. <br /> <br /> I beg to call your attention also to,the traffic condition at Elm Ave. and High St. <br />caused ~argely by the popularity of this new artery recently opened. I believe the roadway <br />should be m~de wider. Its present width is eighteen feet ~ud it is my opinion that it should <br />be made thirty feet wide, giving an additional six feet on each side. I believe if this were <br />done it would greatly help movement of tr~ffic and add to the s~fety of motorists at this inter- <br />section. Th~ recent traffic check made at that corner of the east and west, also north and <br />south traffic, showed practically the same as High and Oourt Sts." <br /> <br /> On motion of Er. Mayo, the recommendations were concurred in, <br /> <br /> 4th. "With reference to the following matters which were referred to me at the 0ouncfl <br />meeting on February 26th: <br /> <br /> Investigation and repor~ if funds were available for curb and guttering on Matthews Terrace <br />and basebaI! ground for boys requested by a delegation from West Park View. In regard to this, <br />I beg to report progress. The petition of this delegation also included recuest for fire hy- <br />drsnt at Matthews Terrace and Guthrie Ave. and light in the l?O0 block of Matthews Terrace. <br />We have numerous requests for lights in very important sections which have been fft~d for many <br />months and only a few lights have been allotted. The s~me applies to fire hydrants. I will go <br />over both of these m~tters thoroughly and report to you at an early date. <br /> <br /> Two matters were referred to the City Attorney and myself. The first was a legal opinion <br />on the liability of the city for construction of a bridge connecting Shea Terrace with Marshall <br />Ward. That petition was presented to the Council by Cassell ~d Oassell, attorneys for Robert <br />L. thea. The matter relative to a legal opinion as to the petition of D. E. Stanley and other <br />property owners in regard tOo~Oning restrictions was also referred to the Attorney and myself. <br />As the City Attorney is out the City, I would much orefer that these recommendations be <br />brought in when he is able to'be present at the Oounci~ meeting." <br /> <br />On motion, the communication was ordered to be filed, <br /> <br /> The President asked that the City Manager investigate and report on the advisability of <br />purchasing low landsuand dumps for use as playgrounds, and that he take up with the Superinten- <br />dent of Public Schools the matter of having the playgrounds around the Schools open after school <br />hours to children in the neighborhoods. <br /> <br /> <br />
