"Portsmouth,
Honorable 0ity Council,
Portsmouth, Va.

April 9, 1929.

Gentlemen:--
At your last meeting you-referred to me~a list of taxes which have been relieved
by the Commissioner of the Revenue~ and which the City Collector is asking to be relieved as
accharge against her office. I find that section $13 of the Stat~ Tax Code of l~8, gives
the Commissioner of the Revenue the power to correct assessments made by him provided the cor-
rection is made within one year, from the 31st day of December of the year in which the assess-
ment was made. In the particular cases in which the relief was made the errors were discovered
when the people attempted to pay the taxes, and the Commissioner of the Revenue made the ~or-
rections at that time. After the ~ax~'payingperiod was over he then made a certification of
the whole to the City Collector. I~have been over each of the corrections of the real estate,
and several of th~ corrections of personal property, including the assessment of machinery
against Isaac Fass, Incorporated. The other corrections of personal property which I had no
means of checking I took up with the Tax Officers. In my opinion all of the taxes were properly
relieved, and should be removed as a charge against the office of the City Collector.

Yottrs very truly,

R. O. Barclay, Oity Attorney."
