<br />
<br /> Pud. "The Oity has spent considerable money in adding to i~s sewer system and has built
<br />two new stations. We have had quite a bit of trouble in enforcing the law in regard to sewer
<br />connections. You realize what position it places the Oity in, after h~ving spent this money,
<br />not to be able to cause' connections to be made. The sewer system, of course, is for the
<br />health a~d welfare of the entire community and in my opinion, after these conditions have been
<br />made to the system, the Oity should not permit certain owners to refuse to connect on account
<br />of the weakness of an ordinance. ~

<br /> After talking the mktter over with the 0ity Attorney, Dr. Roper, Director of Publl~
<br />Health and Welfa~e, has written me in regsmd:to Section 330 of the 01ty ordinance which read~.
<br />'All owners of buildings located along the line of a~y sewer which is a part of the city sewer-
<br />age system, shall causethe same, where it is practicable so to do, to be connect&d~with such
<br />sewerage 'system.~ Under this section of 'the ordinance, which is the onlyexisting ordinmnce
<br />requiring premises to be connected with the sewerage system, it is impossible to force owners
<br />of property wholive out of the city to ma~e connections. I am requesting that the words *or
<br />agents, be incorporated after 'owners~ so that theordinsmce will read 'All owners or agents
<br />of buildings, etc.' There ~re certain properties throughout the city which, on account of
<br />owners living outside of the Oity, we ~are unable to-en~orc~ ~the law in '~gard to sewer con-
<br />nections. I red, est that this be made an emergency me~sure.#

<br /> The following ordinance was presented to cover the Oity Manager's recgmmendation:

<br /> An Ordinance Rec~iring Owners or the Agents of Owners of buildings located along the
<br />Line of the Oity Sewerage System to O0nneot with the said Sewerage System, and Providing
<br />Penalties for the Violation Thereof.
<br />
<br /> On motion of Dr. Dunford, the ordinance was placed on first reading.

<br /> The following report was read from the Oity Attorney:

<br />Dear Sir:--
<br />
<br /> At your meeting held June 2?, 1929, Ecu referred to me a rec~est of The Fleischmann
<br />Oomp~ny to_have refunded $21 paid for license taxes on an automobile, and $26 paid for mer-
<br />chants license for the ~ear 1929. Upon investigation I find that the City had no power to
<br />levy either of the taxes sad The ~leischman Company is legally entitled to have the same re-
<br />funded.
<br />
<br /> As to the automobile, the same is kept in the 0ity of Norfolk and a license is
<br />paid to that city..
<br />
<br /> As to the merchant license, section 1~8 of the State tax code provides that a mer-
<br />chant who has been duly licensed by the State and by a city or town, may, other than at a de-
<br />finite Place of b~siness, sell and deliver at the same time to licensed dealers or retailers,
<br />b~t not ~o. consumers, anywhere in the state without the ~ayment of any additional license tax
<br />of any kind for such privilegetO'the st-ate or to 'any city or town. The ~leischman Company
<br />has no place of business in Portsmouth and sells only to licensed dealers or retailers, and
<br />under this provision the city can not levy a merchants tax on this company. '
