September 2~, 1929

be aporeciated by the U. S. Government, as there is a gate to the Naval Hospital opening into
Fort Lan~, which cauld thsn be used mo~e frequently. How~vem, I think the inconvenience to'
the hospital alone warranms the exoenditure of thzs amounm on the street.
B St. between Hatton St. & Fort Lane-' clay-gravel treated- at an approximate 2,500.00
cos~ of
This street is hard to keep in shape. It has a very high crown caused by constant filling
and requires continuous work to keep it even in, fair condition. The property owner~en this
block ~ave from time to time, for a good many years, endeavored zo have this block paved. It
is practically built up with r'esidential property and I believe it is a worBhy street and
should be paved at this time.
Harrison St. between Second & Fourth S_ts.- clay-gravel treated- at an approximate
2,650.00
oos~ of
This, ~s you well know', is one of the oldest streets in the City. A great deal of atten-
tion is required to keep this street in any condition at all, because of the:dem8mds of our
present day traffic. It would link up with the recent paving in that section..
The total amo'~ut of work above reco~e~ded iS $22,6~O., which comes within the balance
on ha~ud. In going over this program, I h~ve-borne in m~nd,~hat there area good many streets
we would all lkke tohave paved- each of them no doubt having merit, but I have considered
these from every angle possible and my recommendation represents my best judg~en~ in regard
to the e~penditure of the money we have available at this. .time. ~ If the. Council~ approves
.. , w' be ossible for us to immediately beg~n the wor~, ~s a~f~lt pro,ram.
~%°~r~6di%im%l~f th~.year to do the~work. Stewart moved that the 0ity ~an~ger's recommendation and appropriation to cover
same belaid on the table until the next regular meetiBg of Council, and that copies of. same
be furnished each member of the Council. The motion was adopted.

5th. ~Attached you will find a request from the Old Dominion Table Works, signed by their
General Eanager ~r- William Dok. Th'is company is located on the block ~outh of Commerce St.
between ~. Ve-Faon Ave. and Bmoad St. They are asking, as you will note, that the Oity of
Portsmouth co,operate with them in assistiog them to turn out production. They are fi=~uring
on enlarging their plant and ask that the City blose a portion of the alley back of their
factory to enable them to build their factory from ~t. Vernon to Broad St., offering in return
to donate the alley to turn in at their ~roper~y line south and go west into ~t. Vernon Ave.
I have talked this matter over with ~r. W. A, Hall, President of the Compar~y and
have been tb the plant and discussed the matter with the City Engineer. I have also talked
with the City Attorney. At the present time, I am not in a position to ma/~e a definite re-
commendation, because in my opinion, it is largely a ~egal matter. However~ I will state
thmt if it is possible to co-operate with the company and enable them to enlarge their plant
and employ several hundred additional people as they state they will, and i~ can. be~legally
done withou~ injury to any adjoining or other property holders, I see no reason why we~ should
not be glad to close the alley. I am suggRsting that the matter be referred to the 0ity At-
~z~ Ootuucil at an
torney and myself and that a definite recommendation be brought back to the ~'~
early date."
The ~otion was adopted and
Er. Stewart moved that the privilege of the floor be granted to Nr~ W. A. Hall, /he asked
that, if possible, their petition be g~anted.
~r% Cast moved that the petition be referred ~o the OitylAttorney and City Eauager to
ascertain if the 0ity has the arbitrary right to close .the said alley, either for public or
for private purposes, and if no such right exists to ascertain if t~e property owners who signed
the petition for closing said alley represent all the property owners affected.
The motion was adopted.

In this connection, the 0ity Attorne~ presente~ the following ordinance:
An Ordinance to
O~ose that Portion of the Alley lying between BrOad Street ~ud ~ou~t Vernon Avenue~ extending
from Commerce Street to a point die'taut 1~5 feet south thereof.

On motion of ~r. Stewart, the ordinance was placed on first reading.

UNFINISheD BUSINESS

The following report was read from the City Attorney:

Honorable City Council,
Portsmouth, Va.

"September 25, 1929.

Gentlemen:--
At your meeting held on August 13, 1929, you referred to me the petition of Mrs.
Roma $. Friedlin to have refunded certain taxes p~$d by her On omitted land for the years 1926,
192Y, and 1928. This matter was before the City Council in October 192~, upon a petition
filed by the City Realty Corporation. In my report on the petition of that company I stated
~he~following:

"The land in question seems to belong to the estate of F. J. Friedlin. The Assessors of
1925 assessed the land as being 18 feet. Eight feet of lhis land belongs to the property of
Blanche I. Friedlin a~d Roma S. Friedlin fronting on Effingham Street. The other ten foot was
