<br /> The following commuaications were read from the City Manager:
<br /> 1st. '"The Virginia Elec-
<br />tric and Power Company has requested permission to connect its wires to the water mains of
<br />the 0ity in order to effect a return of its c~rrent to its sub-statiOn 4at the foot of Middle
<br />Street. The Oompaay contends that the ~rrent now enters the ground, and causes d~'nage to
<br />the water pipes, and that if the connection is permitted this will be obviated. The Super-
<br />intendent of the Water Deportment has requested that a contract b~ signed protecting the
<br />City,-and providing for the cancellation of the contract upon thirty days notice. He has
<br />prepared the enclosed contract, which has been corrected by the City Attorney, and I respect-
<br />fully recommend that I be authorized to enter into the same~"

<br /> #THIS AGP~EMENT, made this 26th day of November, 1929, between 0ITY OF PORTSMOUTH,.a mu-
<br />nicipal corporation of the State of Virginia, hereinafter called "City," party of the f~rst
<br />part, and the VIRGINIA ELECTRIC AND POWER COMPANY, a corporatio~ hereinafter called "Power
<br />Company," party of the second part;
<br />
<br /> WITNESSETH: Tha~ for ~ud in consideration of the sum of One Dollar ($1~00) cash in
<br />hand paid by the Power Company to the 0ity, the receipt ~hereof is acknowledged, and of the
<br />covenants and agreements hereinafter contained, the City doth grant to the Power Company
<br />permission to make such electrical connections between the water mains of the City and the
<br />negative retura feeders of the electrical railway sMs~em o~ the Power Oompan~y as may be ap-
<br />proved by the City Manager, Portsmouth~ such connections to be made under the supervision
<br />of the Oity Msmager or his represantative, and in accordance with the regulations of the
<br />~ter Department of said City, the cost of a~ch connections to be paid by the Power Oompany.

<br /> The Power Company covenants and agrees that it will us~e all due care in making such
<br />connections and use modern and up to date methods and equipment for said'purpose.
<br />
<br /> The Power Company f~vther agrees that it will indemmify and save harmless the Ofty ~nd
<br />iDs. officials and employees from~any and all dsmages and all claims, demands and suits on
<br />account of the existence of such electrical connections wi~h the pipes of said City, pro-
<br />vided that the Power Oompany is given notice of any such claims and afforded an opportunity
<br />to defend same.

<br /> F~is ement may be cancelled by thirty days notice, in writing by e&ther party to the
<br />other, such cancellation the said Power Company shall ~lmmediately remove all con-
<br />nections made to the pipes of said Oity,
