<br /> ment he found the property rented for a pool room and for soft drinks purposes and he. accord-
<br /> ingly placed it on the Land Books. The Judge adopted the action of the Commissioner of ~the
<br /> Revenue in relieving the property from 1925.

<br /> In January 192~ the Trustees oF the Elks then petitioned the City Council for re-
<br /> lief for the years not relieved by the o~urt. This matter was referred to me, and in view
<br /> of the evidence which was submitted to the court in the month previous I could not see where
<br /> the relief was ~roper, and~I do not think.I reported to the Council, but talked to the attor-
<br /> ney who represented the El~s.

<br /> In Naroh-of some yea=, not given in the notice, ~n in~unction proceedings was'in-
<br />stituted against the City and the City Gollector to prevent the levying on prooerty of the
<br />Elks for the coll~otion of the taxes. ~Y recollection the suit was dropped by-the Elks
<br />upon my recognizing o~r inability to collect the 1926 taxes, which the court has previously
<br />relieved but which at that time had no~ been relieved on the books of the City Collector.

<br /> I have always taken ~ne view tham the taxes were properly assessed ~nd collectable,
<br />and I can not see where ~rs. Eesh is any different from any other person who has lsat money
<br />on real estate and the owner failed to pay the taxes.. If the City Council ~hink that the
<br />circumstances are such that ~rs. Resh should be relieved of the Principal and interest I
<br />think they have the right to do so. ·

<br /> Sometime ago t was authorized to file a petition on behalf of the City in the suit
<br />of George L. Baker, Guardian, vs. ~oses Henry Ba~er, Jr., pending in the Court'of Hustings
<br />for the City of Portsmouth, to enforce the payment of city taxes against certain property
<br />on Glasgow Street. This I did, the property was sold by the court, and the sum of $88~.30
<br />was applied to the payment of the City taxes. In order that the p~rchaser might~buy the
<br />property and have a clear title to the same, the order of the court provided that the above
<br />amount should be paid to the City in full of all city taxes due against the property up to
<br />andinoluding the year 1929. The amount received took care of the taxes due ~or the years
<br />from 1918 to 1~27, and the taxes due on one piece in full for 1Q2~ and a f · ~ ~

<br /> The loss on this property was due to the fact thatthe house ~Umber 310 was
<br />burned, and only a vacant lot was left, and the building number 314 and ~16 was in a very
<br />delapidated condition, and~as n~w~been torn down by the purdhaser.
