<br /> The minutes of the ~e~ar meeting April 2~d were =e~ and were ~p~oved.
<br /> Mr. Oast moved that the p~ivilege of ~he floc= be grated any one who may desire to p=er
<br />sent ~Y ma~te~ to the Co~cil.
<br /> The motion w~ ~opted, ~d Mr. W. L. Parker ~ked that the petition of The First Baptist
<br />Ohuzch of Sou~ po~t~outh for relief of t~es be grated.
<br /> The following w~ =e~ from the Oi~y Attorney's ~eco~endations:
<br /> "Petition of Fi=st B~ti'st Ohu~ch of South portsmouth refer=ed to me at your meeting
<br />held on April 23, 1~3O; The facts in this matte= were develop~ at the he~ing held before
<br />the Oo~t of Hustings in the month of J~e, 1~27. It ~pe~ed from the evidence proddced
<br />before the 0o~t t~t one Jo~ R; Riddiok erected a ch~ch bulling ~or the congregation
<br />of the FirSt ~ptist Ohurch of South Portsmouth. In 1~23 the co~=eg~tlon was required to
<br />=~fi~ce the lo~ then upon the property ~d was unable to do so. John R. ~ddiok made ~-
<br />=~gements ~o ~r=ow the money from the Citizens B~k of~No=folk, but the b~ was ~willing
<br />to lend money to a church, ~d he, Jo~ R. Riddick, had the pzoperty conveyed to him, and
<br />made the lo~ in his o~- n~e. The property then continu~ to st~ in his n~e ~til 1~28,
<br />whe~ it was sold ~de~ a deed' of t~st ~d p~chased ~ the Equitable B~lding Asso~ciation.

<br /> RiddiCk testified t a. ' ....... --~ ~ +~ church- h~lding it fo~ their benefit;

<br /> that he w~ ~ing simply as the T~stee for the church. The Oeu=t took the view that Rid~ck
<br /> had no bene~ioi~ interest in the property, ~d for that =eas6n it relieved the taxes fo= the
<br /> ye~s~192y ~d 1~28. The Oou~t was not asked to relieve ~Y previous year, but ~efused relief
<br /> fo= the ~ 192~' while the property sto~ in the n~e of the Equitable ~ilding Association.
<br /> In view of the de~ision off the Court in relievin~ 1927' ~d 1928 t~es, I believe that the
<br /> t~es foz the ye~ 1~24, due ~d ~o~ting to $~5.25, for the year 192~ $455.63, ~d for the
<br /> ye~ 1~26 $5~.25, s~d upon the' s~e ~sis, and that the ~cil has the zight to zelieve
<br /> the s~e. Acco=ding to the evidence produ~d before the Oo~t, the property, at that time,
<br /> belonged to the church ~d Riddick held it simply as the T~stee of the Oh~ch."

<br /> ~ep~i=ed o= demolish~, as the s~e Is a nuisance ~d menace to his ~zope=ty which adjoins~:
